The equitable principle that allows the recovery of attorney&#8217;s fees to a<\/span> <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8954\" target=\"_blank\" rel=\"noopener\">party<\/a> <span style=\"color: #000000;\">who brings a lawsuit that benefits a significant number of people, requires private enforcement, and is important to society as a whole.<\/span><\/strong><span style=\"color: #000000;\"> [4]<\/span><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"color: #000000;\">\u00a0 \u00a0 \u00a0Many<\/span>\u00a0<a href=\"https:\/\/reunitethestates.org\/\/?page_id=5484\" target=\"_blank\" rel=\"noopener\">civil rights\u00a0statutes<\/a> <span style=\"color: #000000;\">rely on private attorneys general for their enforcement.\u00a0In<\/span>\u00a0<i><a title=\"Newman v. Piggie Park Enterprises, Inc.\" href=\"https:\/\/en.wikipedia.org\/wiki\/Newman_v._Piggie_Park_Enterprises,_Inc.\">Newman v. Piggie Park Enterprises<\/a><span style=\"color: #000000;\">,\u00a0<\/span><\/i><\/strong><span style=\"color: #000000;\">[3]\u00a0<\/span><strong><span style=\"color: #000000;\">one of the earliest cases construing the<\/span>\u00a0<a title=\"Civil Rights Act of 1964\" href=\"https:\/\/en.wikipedia.org\/wiki\/Civil_Rights_Act_of_1964\">Civil Rights Act of 1964<\/a><span style=\"color: #000000;\">, the<\/span>\u00a0<a class=\"mw-redirect\" title=\"United States Supreme Court\" href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_Supreme_Court\">United States Supreme Court<\/a><span style=\"color: #000000;\">\u00a0ruled that &#8220;<\/span><span style=\"color: #800000;\">A public accommodations suit is thus private in form only.\u00a0 When a plaintiff brings an action . . . he cannot recover<\/span>\u00a0<a title=\"Damages\" href=\"https:\/\/en.wikipedia.org\/wiki\/Damages\">damages<\/a><span style=\"color: #800000;\">.\u00a0 If he obtains an<\/span>\u00a0<a title=\"Injunction\" href=\"https:\/\/en.wikipedia.org\/wiki\/Injunction\">injunction<\/a><span style=\"color: #800000;\">, he does so not for himself alone but also as a &#8216;private attorney general.<span style=\"color: #000000;\">&#8221;\u00a0<\/span><\/span><\/strong><\/span><\/p>\n<h2><a href=\"https:\/\/reunitethestates.org\/\/?page_id=9779\" target=\"_blank\" rel=\"noopener\"><em>Newman v. Piggie Park Enterprises, Inc.<\/em>, 390 U.S. 400 (1968)<\/a><span style=\"color: #000000;\">\u00a0<span style=\"font-size: 14pt;\"><strong>&#8211; one who succeeds in obtaining an injunction under Title II of the Civil Rights Act of 1964 should ordinarily recover an attorney&#8217;s fee under \u00a7 204(b).<\/strong><\/span><\/span><\/h2>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"color: #000000;\">\u00a0 \u00a0 \u00a0The\u00a0<\/span><a title=\"United States Congress\" href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_Congress\">United States Congress<\/a>\u00a0<span style=\"color: #000000;\">has also passed laws with &#8220;private attorney general&#8221; provisions that provide for the enforcement of laws prohibiting\u00a0<\/span><a title=\"Employment discrimination\" href=\"https:\/\/en.wikipedia.org\/wiki\/Employment_discrimination\">employment discrimination<\/a>,\u00a0<a title=\"Police brutality\" href=\"https:\/\/en.wikipedia.org\/wiki\/Police_brutality\">police brutality<\/a><span style=\"color: #000000;\">, and\u00a0<\/span><a title=\"Water pollution\" href=\"https:\/\/en.wikipedia.org\/wiki\/Water_pollution\">water pollution<\/a><span style=\"color: #000000;\">. Under the<\/span>\u00a0<a title=\"Clean Water Act\" href=\"https:\/\/en.wikipedia.org\/wiki\/Clean_Water_Act\">Clean Water Act<\/a><span style=\"color: #000000;\">, for example, &#8220;any citizen&#8221; may bring suit against an individual or a company that is a source of<\/span>\u00a0<a title=\"Water pollution\" href=\"https:\/\/en.wikipedia.org\/wiki\/Water_pollution\">water pollution<\/a><span style=\"color: #000000;\">.\u00a0<\/span><\/strong><\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><span style=\"color: #000000;\">\u00a0 \u00a0 \u00a0Another example of the &#8220;private attorney general&#8221; provisions is the<\/span>\u00a0<a title=\"Racketeer Influenced and Corrupt Organizations Act\" href=\"https:\/\/en.wikipedia.org\/wiki\/Racketeer_Influenced_and_Corrupt_Organizations_Act\">Racketeer Influenced and Corrupt Organizations Act<\/a><span style=\"color: #000000;\">\u00a0(RICO). RICO allows average citizens (private attorneys general) to sue those organizations that commit mail and wire fraud as part of their criminal enterprise.<\/span><\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><span style=\"color: #000000;\">\u00a0 \u00a0 \u00a0The U.S. Congress codified the private attorney general principle into law with the enactment of<\/span>\u00a0<a title=\"Civil Rights Attorney's Fees Award Act of 1976\" href=\"https:\/\/en.wikipedia.org\/wiki\/Civil_Rights_Attorney%27s_Fees_Award_Act_of_1976\">Civil Rights Attorney&#8217;s Fees Award Act of 1976<\/a><span style=\"color: #000000;\">:<\/span><\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/\/?page_id=9789\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">42 U.S.C. \u00a7 1988.
