Puterbaugh mentions several, which are each\u00a0listed and defined below alongside several other outdated types of <a href=\"https:\/\/reunitethestates.org\/\/?page_id=5154\" target=\"_blank\" rel=\"noopener\">pleadings<\/a>:<\/span><\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<p><strong><span style=\"font-size: 14pt;\">\u00a0 \u00a0 \u201c<span style=\"color: #800000;\">The [<a style=\"color: #800000;\" href=\"https:\/\/reunitethestates.org\/\/?page_id=3983\">common-law<\/a>] pleadings in a cause are commenced, on the part of the <span style=\"color: #008000;\"><a style=\"color: #008000;\" href=\"https:\/\/reunitethestates.org\/\/?page_id=8939\" target=\"_blank\" rel=\"noopener\">plaintiff<\/a><\/span>, with the declaration, which is a statement in writing of his cause of action, in legal form.\u00a0 This declaration, as every other <a href=\"https:\/\/reunitethestates.org\/\/?page_id=5154\" target=\"_blank\" rel=\"noopener\">pleading<\/a> in the cause, is required to be framed agreeable to the established rules &amp; forms of pleading, &amp; if defective in any particular either in substance or form, <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8204\" target=\"_blank\" rel=\"noopener\">may be objected to, as insufficient in law<\/a>, by <span style=\"color: #008000;\"><a style=\"color: #008000;\" href=\"https:\/\/reunitethestates.org\/\/?page_id=9159\" target=\"_blank\" rel=\"noopener\">demurrer<\/a><\/span>, on the part of <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8945\" target=\"_blank\" rel=\"noopener\">defendant<\/a>; or he may allege some matter in abatement of the action, or he may deny the declaration to be true in point of fact, or may set up matter in avoidance of it \u2014 such answer on the part of the <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8945\" target=\"_blank\" rel=\"noopener\">defendant<\/a> being technically denominated his plea. <\/span><\/span><\/strong><\/p>\n<p style=\"text-align: left;\" align=\"JUSTIFY\"><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\">\u00a0 \u00a0 \u00a0To the defense thus made, the <a style=\"color: #800000;\" href=\"https:\/\/reunitethestates.org\/\/?page_id=5163\">plaintiff<\/a> may again, in his turn, reply, either, in case of a <a href=\"https:\/\/reunitethestates.org\/\/?page_id=9159\" target=\"_blank\" rel=\"noopener\">demurrer<\/a>, by reasserting his declaration to be sufficient in law to support this action, &amp; referring that question to the judgment of the court, which is termed a joinder in demurrer; or, in the case of a special plea, he may on his part demur to such plea, as insufficient in law to constitute a defense; or he may deny it to be true in point of fact, or allege some new matter in avoidance of it, according to the circumstances \u2014 such answer being styled a replication. <\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left;\" align=\"JUSTIFY\"><span style=\"font-size: 14pt;\"><strong><span style=\"color: #800000;\">\u00a0 \u00a0 \u00a0To the replication the <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8945\" target=\"_blank\" rel=\"noopener\">defendant<\/a> may either demur upon the law, or oppose a <span style=\"color: #ff00ff;\">rejoinder<\/span> as to the fact; &amp; to the rejoinder the plaintiff may demur, or oppose a surrejoinder; &amp; so the parties may proceed, by a system of alternate allegation &amp; objection, denial or evasion, technically termed the pleadings, until they arrive at an issue, that is, some specific point of law, or fact, affirmed on one side &amp; denied on the other, &amp; presenting the exact question for the court or jury to determine.<\/span>\u201d<\/strong>\u00a0[3]<\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/\/?page_id=9089\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">Counter-Complaint<\/span><\/a> &#8211; a complaint filed by a <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8945\" target=\"_blank\" rel=\"noopener\">defendant<\/a> against the plaintiff, alleging that the plaintiff has committed a breach and is liable to the <a href=\"https:\/\/reunitethestates.org\/\/?page_id=8945\" target=\"_blank\" rel=\"noopener\">defendant<\/a> for\u00a0damages.<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\"><strong>The historical counter-complaint appears to have been banned from the Federal Rules of Civil Procedure <\/strong>(see <a href=\"https:\/\/reunitethestates.org\/\/?page_id=4140\" target=\"_blank\" rel=\"noopener\"><strong>Rule 7<\/strong><\/a>)<strong>, and\u00a0<em>replaced\u00a0<\/em>with the equally-effective\u00a0<em>and<\/em>\u00a0more cost-effective<em>\u00a0<\/em><a href=\"https:\/\/reunitethestates.org\/\/?page_id=9103\" target=\"_blank\" rel=\"noopener\">counterclaim<\/a>.<\/strong> See <strong><a href=\"https:\/\/reunitethestates.org\/\/?page_id=4196\" target=\"_blank\" rel=\"noopener\">Fed.
