Anyone who is an employee of t<span class=\"text_exposed_show\">he court (EXAMPLES: a judge; a bailiff; a marshal; a clerk) or a person who, although not an employee of the\u00a0<\/span><\/span><span style=\"font-size: 14pt;\">court, is obligated to conduct himself in a manner that furthers the administration of justice (EXAMPLE: any attorney admitted to practice before the court).\u00a0<\/span><\/strong><span style=\"font-size: 14pt;\">[2]<\/span><\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/\/?page_id=8842\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">Judge<\/span><\/a> <span style=\"color: #000000;\">&#8211;\u00a0a public official appointed or elected to\u00a0hear and decide legal matters in in court; a judicial officer who has the authority to administer justice.\u00a0<\/span><\/span><\/strong><span style=\"font-size: 14pt; color: #000000;\">[1]<\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0 \u00a0 \u00a0The\u00a0judge\u00a0presides in the courtroom. If a case is tried before a jury, the judge rules on points of law and gives instructions to the jury, informing the jury about the law that governs the case. (The jury determines the facts based on the evidence presented.) If there is no jury, the judge determines the facts and decides the verdict &#8211; e.g., finding of guilty or not guilty in a criminal case, or a finding for or against the plaintiff in a civil trial.<\/strong> [2]<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\">clerk<\/span> &#8211;<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0 \u00a0 \u00a0The\u00a0court clerk\u00a0or bailiff usually administers the oath to prospective jurors and to witnesses. The clerk is also in charge of physical exhibits introduced into evidence and is responsible for other administrative aspects of a trial.<\/strong> [2]<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\">bailiff<\/span> &#8211;<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0 \u00a0 \u00a0The\u00a0bailiff\u00a0keeps order in the courtroom, calls the witnesses and is in charge of the jury, as directed by the judge. It is the bailiff&#8217;s duty to be certain no one attempts to influence the jury.<\/strong> [2]<\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/\/wp-admin\/post.php?post=8806&amp;action=edit\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">sheriff<\/span><\/a> <span style=\"color: #000000;\">&#8211;\u00a0usually an elected office, duties include custodian of\u00a0the county jail, executes civil and criminal process, and carries out judicial mandates within the county.<\/span><\/span><\/strong><\/p>\n<p><strong><a href=\"https:\/\/reunitethestates.org\/\/?page_id=8820\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">deputy sheriff<\/span><\/a> <span style=\"font-size: 14pt; color: #000000;\">&#8211;\u00a0an officer who, acting under the direction of a sheriff, may perform most of the duties of the sheriff \u2019s office.<\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/\/?page_id=8852\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">marshal<\/span><\/a> <span style=\"color: #000000;\">&#8211; judicial officer who provides court security, executes process (carries out orders), and performs other tasks for the court.<\/span><\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 18pt;\">court reporter<\/span><\/strong> &#8211;<\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\">\u00a0 <strong>\u00a0 \u00a0The\u00a0court reporter\u00a0records\u00a0verbatim\u00a0(word for word) everything that is said as part of the formal proceedings in the courtroom, including<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\">the testimony of the witnesses,<\/span><\/strong><\/span><\/li>\n<li><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\">objections made by the lawyers, and<\/span><\/strong><\/span><\/li>\n<li><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\">the judge&#8217;s rulings on those objections.<\/span><\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0 \u00a0 \u00a0In many jurisdictions, audio or audio-visual tapes are used to record the trial in lieu of a court reporter, particularly at the misdemeanor level.
