1. An estate in land held in fee simple, in fee tail, or for term of life; any real property interest that is or may become possessory.\u00a0 *\u00a0 At common law, these estates were all created by enfeoffment with liver; of seisin.<\/span><\/strong><\/span><\/p>\n

The tenure by which such an estate is held.\u00a0<\/strong> \u2014 aka<\/span> freehold estate<\/span><\/strong><\/em>; estate in freehold<\/strong><\/em><\/span>; freehold interest<\/span><\/strong><\/em>; frank-tenement<\/strong><\/em><\/span>; liberum tenementum<\/strong><\/em><\/span>. \u00a0Cf. Various Types of Freeholds:<\/span><\/strong><\/p>\n

determinable freehold<\/a><\/span> – a freehold estate that is defeasible (capable of being cancelled) by operation of a special limitation.<\/span><\/strong><\/span><\/p>\n

perpetual freehold<\/span><\/a> – an estate given to a grantee for life, and then successively to the grantee\u2019s heirs for life.<\/span><\/span><\/strong><\/p>\n

charter land<\/span><\/a> – “freehold land” held under royal charter or deed (generally for churches and leaders).<\/span><\/span><\/strong><\/p>\n

flying freehold<\/span><\/a> – the part of a freehold property that encroaches on another owner\u2019s property, not on the ground but above it, as with a balcony that extends over the property line.<\/span><\/span><\/strong><\/p>\n

movable freehold<\/span><\/a> – real property capable of being increased or diminished by natural causes, such as the land a seashore owner acquires or loses as water recedes or approaches.<\/span><\/span><\/strong><\/p>\n
