A fee that has some qualification connected to it and that terminates whenever the <\/b>qualification<\/b><\/span>\u00a0terminates.\u00a0 *\u00a0 An example of the words creating a base fee are \u201cto A and his heirs, tenants of the manor\u00a0<\/b><\/span>of Tinsleydale,\u201d which would terminate when A or his heirs are no longer tenants of the manor of Tinsleydale.\u00a0\u00a0<\/span>Among the base fees at common law are the fee simple subject to a condition subsequent<\/em> and the conditional fee<\/em>.<\/strong> \u2014 aka determinable fee<\/strong><\/em><\/span>;\u00a0limited fee<\/strong><\/em><\/span>.<\/span><\/p>\n

\u00a0 \u00a0 \u00a0“A base fee is a particular kind of determinable fee. The\u00a0<\/span><\/span>two essentials of a base fee are<\/span><\/strong><\/p>\n

(a) it continues only so long as the original grantor or any heirs of his body are alive; and
\n(b) there is a remainder or reversion after it. . . . <\/span><\/strong><\/span><\/p>\n

In effect a base fee was a fee simple which endured for as long as the entail would have continued if it had not been barred, and determined when the entail would have ended.<\/span>\u201d<\/strong> [4]<\/span><\/p>\n
