The retention of a benefit conferred by another, who offered no <a href=\"https:\/\/reunitethestates.org\/?page_id=10851\" target=\"_blank\" rel=\"noopener\">compensation<\/a>,\u00a0<\/strong><strong>in circumstances where <a href=\"https:\/\/reunitethestates.org\/?page_id=10851\" target=\"_blank\" rel=\"noopener\">compensation<\/a> is reasonably expected. <\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #000000;\"><span style=\"font-size: 14pt;\"><strong>2. A benefit obtained from\u00a0<\/strong><strong>another, not intended as a gift &amp; not legally justifiable, for which the beneficiary must make\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong><a href=\"https:\/\/reunitethestates.org\/?page_id=6911\" target=\"_blank\" rel=\"noopener\">restitution<\/a> or <a href=\"https:\/\/reunitethestates.org\/?page_id=10988\" target=\"_blank\" rel=\"noopener\">recompense<\/a>.\u00a0 Unjust enrichment is a basis of a civil liability involving a claim\u00a0<\/strong><strong>for recovery that sometimes also goes by the name of <a href=\"https:\/\/reunitethestates.org\/?page_id=6911\" target=\"_blank\" rel=\"noopener\">restitution<\/a>. Instances of unjust\u00a0<\/strong><strong>enrichment typically arise when property is transferred by an act of wrongdoing <\/strong><em>(as by<\/em><\/span><\/span><br \/>\n<span style=\"font-size: 14pt; color: #000000;\"> <em> conversion or breach of fiduciary duty)<\/em><strong>, or without the effective consent of the transferor\u00a0<\/strong><em>(as in a case of mistake)<\/em><strong>, or when a benefit is conferred deliberately but without a contract, and<\/strong><strong> the court concludes that the absence of a contract is excusable \u2014 as when the benefit was\u00a0<\/strong><strong>provided in an emergency, or when parties once seemed to have a contract but it turns out to\u00a0<\/strong><strong>be invalid. The resulting claim of unjust enrichment seeks to recover the defendant&#8217;s gains.<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 14pt; color: #000000;\"><strong>3. The area of law dealing with unjustifiable benefits of this kind. <\/strong>[1]<\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1. The circumstances which give rise to the obligation of <a href=\"https:\/\/reunitethestates.org\/?page_id=6911\" target=\"_blank\" rel=\"noopener\">restitution<\/a>, that is, the receiving and retention of property, money, or benefits which in justice and equity belong to another.\u00a0 <span style=\"color: #800000;\"><em>Herrmann v Gleason<\/em> (CA6 Mich) 126 F2d 936<\/span>; <span style=\"color: #800000;\"><em>Straube v Bowling Green Gas Co<\/em>. 360 Mo 132, 227 SW2d 666, 18 ALR2d 1335<\/span>.<\/strong> [2]<\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1.
