Types of Orders:<\/strong><\/span><\/p>\n

injunction<\/a><\/span> – an order (or<\/span> writ<\/a>) commanding or preventing an action that the plaintiff has shown to be necessary to prevent injury.<\/span><\/strong><\/span><\/p>\n

subpoena<\/a><\/span> – command a person to appear in court, subject to a penalty for failing to comply.<\/span><\/strong><\/span><\/p>\n

show cause order<\/a><\/span>\u00a0<\/strong>– <\/em>directs\u00a0a party to appear in court & explain why the party took\u00a0(or failed to take)\u00a0some action or why the court should or should not impose some sanction or grant some relief.<\/strong><\/span><\/span><\/p>\n

peremptory mandamus<\/a> <\/span>– an absolute command to the defendant after they default on, or fail to show sufficient cause in answer to, an alternative mandamus.<\/span><\/strong><\/span><\/p>\n

interlocutory<\/a> <\/span>– a temporary order not constituting a final resolution of the whole controversy.<\/span><\/strong><\/span><\/p>\n

mandate (i)<\/a> – judicial command directed to an officer of the court to enforce a\u00a0court order.<\/span><\/strong><\/span><\/p>\n

mandate (ii)<\/a><\/span> – order from an appellate court directing a lower court to take\u00a0a specified action.<\/strong><\/span><\/p>\n

minute order<\/a>\u00a0<\/span>–\u00a0An order<\/a> recorded in the minutes of the court rather than directly on a case docket., often not directly relating to a case, such as an order adopting a local rule of court.\u00a0<\/strong><\/span><\/p>\n

remittitur<\/a> <\/span>– an order requiring a Plaintiff to choose between a new trial or lowering the damages amount below what the jury had awarded.<\/span><\/strong><\/span><\/p>\n

additur<\/a> <\/span>– with the defendant’s consent, increases the jury’s award of damages to avoid a new trial on grounds of inadequate damages.<\/span><\/strong><\/span><\/p>\n
