Cavanagh&#8217;s\u00a0<a href=\"https:\/\/www.amazon.com\/Litigation-Federal-Civil-Tax-Controversies\/dp\/0791330184\" target=\"_blank\" rel=\"noopener\">Litigation of Federal Civil Tax Controversies<\/a>:<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 14pt;\"><strong>\u00a0 \u00a0 \u00a0\u201c<span style=\"color: #800000;\">A motion to sever is made to separate parties or issues<\/span><\/strong><\/span><br \/>\n<span style=\"font-size: 14pt; color: #800000;\"><strong>included in a single <a href=\"https:\/\/reunitethestates.org\/?page_id=7876\" target=\"_blank\" rel=\"noopener\">cause of action<\/a>.\u00a0 Typically, such a motion is\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>made where severance will result in a more efficient disposition\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>of the case.\u00a0 For example, one party or claim may be subject to a\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>jurisdictional defense not applicable to the remainder of the\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>action. A party moving for severance should be prepared to\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>demonstrate with particularity the grounds supporting the\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>motion. . A motion to sever is favored by the court &#8216;when it\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>allows one significant issue in a multi-issue case to be resolved\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>by the court in a manner that encourages settlement of the\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>remainder of the case. For example, where the resolution of a\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>statute of limitations issue or other jurisdictional question as a\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>preliminary matter can reduce the likelihood of further trial on\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>the substantive issues, the motion should be favorably\u00a0<\/strong><\/span><span style=\"font-size: 14pt; color: #800000;\"><strong>considered.
