Curzon, Ienglish Legal History 103 (2d ed. 1979):<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u201c<span style=\"color: #800000;\">The writ of audita querela<\/span><\/strong> (= quarrel having been\u00a0heard)<span style=\"color: #800000;\"><strong>&#8230; introduced during the time of Edward III, was\u00a0<\/strong><\/span><span style=\"color: #800000;\"><strong>available to re-open a judgment in certain circumstances. It\u00a0<\/strong><\/span><span style=\"color: #800000;\"><strong>was issued as a remedy to a defendant where an important\u00a0<\/strong><\/span><span style=\"color: #800000;\"><strong>matter concerning his case had arisen since the judgment. Its\u00a0<\/strong><\/span><span style=\"color: #800000;\"><strong>issue was based on equitable, rather than common law<\/strong><\/span><\/span><br \/>\n<span style=\"font-size: 14pt;\"><strong><span style=\"color: #800000;\">principles.<\/span>\u201d<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u00a0 \u00a0 \u00a0Excerpt from 7A C.J.S.
