Jur. 2d Executions and Enforcement of Judgments \u00a7<br \/>\n14, at 50-51 (1994):<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 14pt;\"><strong>\u00a0 \u00a0 \u00a0\u201c<span style=\"color: #800000;\">The writ of \u2018fieri facias\u2019<\/span> <em>(commonly called a writ of \u2018fi\u00a0<\/em><em>fa\u2019)<\/em><span style=\"color: #800000;\">, which commanded literally \u2018that you cause to be made,\u2019\u00a0<\/span><span style=\"color: #800000;\">was an early common-law means of enforcing payment on a\u00a0<\/span><span style=\"color: #800000;\">judgment; it was, in effect, an order to the sheriff of the court\u00a0<\/span><span style=\"color: #800000;\">to enforce a judgment against the debtor by levy, seizure, &amp;\u00a0<\/span><span style=\"color: #800000;\">sale of his personalty to the extent needed to satisfy a\u00a0<\/span><span style=\"color: #800000;\">judgment.<\/span>\u201d<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #800000;\"><em>Fieri<\/em><\/span>:<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 18pt;\">\u201c[Latin] (17c.) <strong>To be made; to be done.<\/strong> Fieri usually appears as part of the\u00a0<\/span><span style=\"font-size: 18pt;\">phrase in jieri. See IN FIERI.\u201d<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #800000;\"><em>fieri facias de bonis ecclesiasticis<\/em><\/span>:<\/strong><\/span> \u201c[Latin &#8216;that you cause to be made of the\u00a0<\/span><span style=\"font-size: 14pt;\">ecclesiastical goods&#8217;] (1827) <em>Hist<\/em>. <strong>A writ of execution \u2013 used when the\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong>defendant was a beneficed clerk who had no lay fee that commanded the bishop to\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong>satisfy the judgment from the ecclesiastical goods &amp; chattels of the defendant\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong>within the diocese. This was accomplished by issuing a sequestration to levy the\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong>debt out of the defendant\u2019s benefice. This writ was issued after a fieri facias had been returned nulla bona.<\/strong>\u201d<\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #800000;\"><em>fieri facias de bonis propriis<\/em><\/span>:<\/strong><\/span> \u201c[Latin &#8216;that you cause to be made of his own\u00a0<\/span><span style=\"font-size: 14pt;\">goods&#8217;] (17c.) <em>Hist<\/em>. <strong>A writ that executes on an executor\u2019s property when a writ\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong>fieri facias de bonis testatoris is returned by the sheriff nulla harm or devastavit<\/strong> (a\u00a0<\/span><span style=\"font-size: 14pt;\">wasting of the testator\u2019s goods by the executor)<strong>.<\/strong>\u201d<\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><em><span style=\"color: #800000;\">fieri facias de bonis testatoris<\/span><\/em>:<\/strong><\/span> \u201c[Latin &#8216;that you cause to be made of the testator\u2019s<\/span><br \/>\n<span style=\"font-size: 14pt;\">goods&#8217;] (17c.) <em>Hist<\/em>. <strong>A writ of execution served on an executor for a debt incurred\u00a0<\/strong><\/span><span style=\"font-size: 14pt;\"><strong>by the testator.<\/strong>\u201d<\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #800000;\"><em>fieri feci<\/em><\/span>:<\/strong><\/span> \u201c[Latin &#8216;I have caused to be made&#8217;] (17c.) <em>Hist<\/em>. <strong>A sheriff\u2019s return on a\u00a0<em>fieri facias<\/em> for which the sheriff has collected, in whole or in part, the sum to be<\/strong><\/span><br \/>\n<span style=\"font-size: 14pt;\"><strong>levied on.
