\u00a0 \u00a0 \u00a0The<\/span>\u00a011 Common Law<\/em> Forms of Action<\/a>\u00a0can be executed via various types of<\/span> writs<\/a>. \u00a0Another (more modern) way to activate the relief these forms of action can provide is by filing a<\/span> civil action<\/a>.<\/span><\/strong><\/span><\/p>\n

\u00a0 \u00a0 \u00a0The following 4 forms of action are used for the purpose of recovering property, wrongfully imprisoned, detained, or withheld persons, &\/or damages caused by such losses<\/span> <\/strong>(damages can be filed for through a tort claim<\/a><\/strong>)<\/span>:<\/strong><\/span><\/em><\/span><\/p>\n

#1.)<\/span> Detinue<\/a><\/span> – recover “personal property” <\/span><\/span><\/strong>(movable or intangible assets, but not “real property” such as land or buildings)<\/em><\/strong><\/span><\/p>\n

#2.)<\/span> Ejectment <\/a><\/strong><\/span>– an owner or occupier who was wrongfully ejected from their land (home, etc.) recovers possession, damages, & costs<\/span><\/strong><\/span><\/p>\n

#3.)<\/span> Replevin<\/a><\/span> – to repossess:<\/span><\/strong><\/span><\/p>\n
