{"id":5127,"date":"2017-08-14T21:28:07","date_gmt":"2017-08-14T21:28:07","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=5127"},"modified":"2017-08-15T23:35:46","modified_gmt":"2017-08-15T23:35:46","slug":"rule-4i-serving-the-united-states-and-its-agencies-corporations-officers-or-employees","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=5127","title":{"rendered":"Rule 4(i)\u00a0&#8211; Serving the United States and its Agencies, Corporations, Officers, or Employees."},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong>(i)<\/strong>\u00a0<strong><em>Serving the United States and its Agencies, Corporations, Officers, or Employees.<\/em><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong>(1)\u00a0<em>United States<\/em>. <\/strong>To serve the United States, a party must:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A)<\/span><\/p>\n<p style=\"padding-left: 90px;\"><span style=\"font-size: 14pt;\">(i) deliver a copy of the summons and of the complaint to the United States attorney for the district where the action is brought\u2013or to an assistant United States attorney or clerical employee whom the United States attorney designates in a writing filed with the court clerk\u2013or<\/span><\/p>\n<p style=\"padding-left: 90px;\"><span style=\"font-size: 14pt;\">(ii) send a copy of each by registered or certified mail to the civil-process clerk at the United States attorney\u2019s office;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) send a copy of each by registered or certified mail to the Attorney General of the United States at Washington, D.C.; and<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(C) if the action challenges an order of a nonparty agency or officer of the United States, send a copy of each by registered or certified mail to the agency or officer.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong>(2)\u00a0<em>Agency; Corporation; Officer or Employee Sued in an Official Capacity<\/em>. <\/strong>To serve a United States agency or corporation, or a United States officer or employee sued only in an official capacity, a party must serve the United States and also send a copy of the summons and of the complaint by registered or certified mail to the agency, corporation, officer, or employee.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong>(3)\u00a0<em>Officer or Employee Sued Individually<\/em>. <\/strong>To serve a United States officer or employee sued in an individual capacity for an act or omission occurring in connection with duties performed on the United States\u2019 behalf <em>(whether or not the officer or employee is also sued in an official capacity)<\/em>, a party must serve the United States and also serve the officer or employee under<strong> Rule 4(e), (f), or (g).<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong>(4)\u00a0<em>Extending Time<\/em>.<\/strong> The court must allow a party a reasonable time to cure its failure to:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) serve a person required to be served under <strong>Rule 4(i)(2)<\/strong>, if the party has served either the United States attorney or the Attorney General of the United States; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) serve the United States under <strong>Rule 4(i)(3)<\/strong>, if the party has served the United States officer or employee.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(i)\u00a0Serving the United States and its Agencies, Corporations, Officers, or Employees.
