{"id":5124,"date":"2017-08-14T21:26:02","date_gmt":"2017-08-14T21:26:02","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=5124"},"modified":"2017-08-15T23:35:32","modified_gmt":"2017-08-15T23:35:32","slug":"rule-4h-serving-a-corporation-partnership-or-association","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=5124","title":{"rendered":"Rule 4(h)\u00a0&#8211; Serving a Corporation, Partnership, or Association."},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong>(h)\u00a0<em>Serving a Corporation, Partnership, or Association.<\/em><\/strong> <strong>Unless<\/strong> federal law provides otherwise or <strong>the defendant\u2019s waiver has been filed<\/strong>, <strong>a domestic or foreign corporation, or a partnership or other unincorporated association<\/strong> that is subject to suit under a common name, <strong>must be served<\/strong>:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) <strong>in a judicial district of the United States<\/strong>:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) <strong>in the manner prescribed by Rule 4(e)(1) <\/strong>for serving an individual; <strong>or<\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) <strong>by delivering a copy of the summons and of the complaint to an officer<\/strong>, a managing or general agent, or any other agent authorized by appointment or by law to receive service of process <strong>and- if the agent is one authorized by statute and the statute so requires- by also mailing a copy of each to the defendant; or<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) at a place not within any judicial district of the United States, in any manner prescribed by<strong> Rule 4(f) <\/strong>for serving an individual, except personal delivery under<strong> (f)(2(C)(i).<\/strong><\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(h)\u00a0Serving a Corporation, Partnership, or Association.
