{"id":5123,"date":"2017-08-14T21:25:16","date_gmt":"2017-08-14T21:25:16","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=5123"},"modified":"2017-08-15T23:36:39","modified_gmt":"2017-08-15T23:36:39","slug":"rule-4g-serving-a-minor-or-an-incompetent-person","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=5123","title":{"rendered":"Rule 4(g)\u00a0&#8211; Serving a Minor or an Incompetent Person."},"content":{"rendered":"<p><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><strong>(g)\u00a0<\/strong><em><strong>Serving a Minor or an Incompetent Person<\/strong>.<\/em> A minor or an incompetent person in a judicial district of the United States <strong>must be served by following state law<\/strong> for serving a summons or like process on such a defendant in an action brought in the courts of general jurisdiction of the state where service is made. \u00a0<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">\u00a0 \u00a0 A minor or an incompetent person who is not within any judicial district of the United States must be served in the manner prescribed by<strong> Rule 4(f)(2)(A), (f)(2)(B), or (f)(3) .<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 18pt; color: #800080; font-family: arial, helvetica, sans-serif;\"><strong>Rule 4(f)(2)(A), (f)(2)(B), or (f)(3):<\/strong><\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14pt;\"><strong>(f)\u00a0Serving an Individual in a Foreign Country.\u00a0<\/strong>Unless federal law provides otherwise, an individual\u2013other than a minor, an incompetent person, or a person whose waiver has been filed\u2013 may be served at a place not within any judicial district of the United States:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14pt;\">(2) if there is no internationally agreed means, or if an international agreement allows but does not specify other means, by a method that is reasonably calculated to give notice:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14pt;\">(A) as prescribed by the foreign country\u2019s law for service in that country in an action in its courts of general jurisdiction;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14pt;\">(B) as the foreign authority directs in response to a<strong>letter rogatory<\/strong>\u00a0or\u00a0<strong>letter of request<\/strong>; or<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14pt;\">(3) by other means not prohibited by international agreement, as the court orders.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 18pt; font-family: arial, helvetica, sans-serif;\"><strong>Definition of\u00a0<span style=\"color: #800000;\">ROGATORY LETTER\u00a0<\/span>aka\u00a0<span style=\"color: #800000;\">LETTER OF REQUEST<\/span>:<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><strong>\u201c1. A document issued by one court to a foreign court, requesting that the foreign court 1.) take evidence from a specific person within the foreign jurisdiction or serve process on an individual or corporation within the foreign jurisdiction &amp; 2.) return the testimony or proof of service for use in a pending case<\/strong>.\u00a0<em>\u2014 Also termed letter rogatory; rogatory letter;\u00a0<\/em><em>requisitory letter.<\/em>\u00a0<strong>2.
