{"id":5118,"date":"2017-08-14T21:21:50","date_gmt":"2017-08-14T21:21:50","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=5118"},"modified":"2017-08-15T23:34:48","modified_gmt":"2017-08-15T23:34:48","slug":"rule-4e-serving-an-individual-within-a-judicial-district-of-the-united-states","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=5118","title":{"rendered":"Rule 4(e) &#8211; Serving an Individual Within a Judicial District of the United States."},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong>(e)\u00a0<\/strong><em><strong>Serving an Individual Within a Judicial District of the United States<\/strong>.<\/em> Unless federal law provides otherwise, <strong>an individual<\/strong>\u2013 other than a minor, an incompetent person, or a person whose waiver has been filed\u2013\u00a0<strong>may be served in a judicial district of the United States by:<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)<strong> following state law for serving a summons <\/strong>in an action brought in courts of general jurisdiction in the state where the district court is located or where service is made; or<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) doing any of the following:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) <strong>delivering a copy of the summons and of the complaint to the individual personally<\/strong>;\u00a0<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) <strong>leaving a copy of each at the individual\u2019s dwelling or usual place of abode with someone of suitable age and discretion who resides there<\/strong>; or\u00a0<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(C) <strong>delivering a copy of each to an agent authorized by appointment or by law to receive service of process<\/strong>.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(e)\u00a0Serving an Individual Within a Judicial District of the United States.
