Motions and Supporting Affidavits"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><a href=\"https:\/\/reunitethestates.org\/\/?page_id=4728\" target=\"_blank\" rel=\"noopener\">Rules of Criminal Procedure<\/a><\/span><br \/>\n<a href=\"https:\/\/reunitethestates.org\/\/?page_id=4746\" target=\"_blank\" rel=\"noopener\">Title IV &#8211; General Provisions<\/a><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(a) <strong>In General<\/strong>. A party applying to the court for an order must do so by motion.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b) <strong>Form and Content of a Motion<\/strong>. A motion\u2014except when made during a trial or hearing\u2014must be in writing, unless the court permits the party to make the motion by other means. A motion must state the grounds on which it is based and the relief or order sought. A motion may be supported by affidavit.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c) <strong>Timing of a Motion<\/strong>. A party must serve a written motion\u2014other than one that the court may hear ex parte\u2014and any hearing notice at least 7 days before the hearing date, unless a rule or court order sets a different period. For good cause, the court may set a different period upon ex parte application.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(d) <strong>Affidavit Supporting a Motion<\/strong>. The moving party must serve any supporting affidavit with the motion.
