Defendant\u2019s Presence"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">(a) <strong>When Required<\/strong>. Unless this rule, <a href=\"https:\/\/www.federalrulesofcriminalprocedure.org\/title-ii\/rule-5\/\">Rule 5<\/a>, or <a href=\"https:\/\/www.federalrulesofcriminalprocedure.org\/title-iv\/rule-10-arraignment\/\">Rule 10<\/a> provides otherwise, the defendant must be present at:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) the initial appearance, the initial arraignment, and the plea;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) every trial stage, including jury impanelment and the return of the verdict; and<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(3) sentencing.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b) <strong>When Not Required<\/strong>. A defendant need not be present under any of the following circumstances:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) <em>Organizational Defendant<\/em>. The defendant is an organization represented by counsel who is present.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) <em>Misdemeanor Offense<\/em>. The offense is punishable by fine or by imprisonment for not more than one year, or both, and with the defendant\u2019s written consent, the court permits arraignment, plea, trial, and sentencing to occur by video teleconferencing or in the defendant\u2019s absence.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(3) <em>Conference or Hearing on a Legal Question<\/em>. The proceeding involves only a conference or hearing on a question of law.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(4) <em>Sentence Correction<\/em>. The proceeding involves the correction or reduction of sentence under <a href=\"https:\/\/www.federalrulesofcriminalprocedure.org\/title-vii\/rule-35-correcting-or-reducing-a-sentence\/\">Rule 35<\/a> or 18 U.S.C. \u00a73582 (c).<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c) <strong>Waiving Continued Presence<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) <em>In General<\/em>. A defendant who was initially present at trial, or who had pleaded guilty or nolo contendere, waives the right to be present under the following circumstances:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) when the defendant is voluntarily absent after the trial has begun, regardless of whether the court informed the defendant of an obligation to remain during trial;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) in a noncapital case, when the defendant is voluntarily absent during sentencing; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(C) when the court warns the defendant that it will remove the defendant from the courtroom for disruptive behavior, but the defendant persists in conduct that justifies removal from the courtroom.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) <em>Waiver\u2019s Effect<\/em>. If the defendant waives the right to be present, the trial may proceed to completion, including the verdict\u2019s return and sentencing, during the defendant\u2019s absence.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) When Required.
