Indicative Ruling on a Motion for Relief That Is Barred by a Pending Appeal"},"content":{"rendered":"<p>(a) <strong>Relief Pending Appeal<\/strong>. If a timely motion is made for relief that the court lacks authority to grant because of an appeal that has been docketed and is pending, the court may:<\/p>\n<p style=\"padding-left: 30px;\">(1) defer considering the motion;<\/p>\n<p style=\"padding-left: 30px;\">(2) deny the motion; or<\/p>\n<p style=\"padding-left: 30px;\">(3) state either that it would grant the motion if the court of appeals remands for that purpose or that the motion raises a substantial issue.<\/p>\n<p>(b) <strong>Notice to the Court of Appeals<\/strong>. The movant must promptly notify the circuit clerk under <a href=\"https:\/\/www.federalrulesofappellateprocedure.org\/title-ii\/rule-12-1\/\" target=\"_blank\" rel=\"noopener\">Federal Rule of Appellate Procedure 12.1<\/a> if the district court states that it would grant the motion or that the motion raises a substantial issue.<\/p>\n<p>(c) <strong>Remand<\/strong>.
