These rules apply to proceedings before:<\/p>\n<ul>\n<li>United States district courts;<\/li>\n<li>United States bankruptcy and magistrate judges;<\/li>\n<li>United States courts of appeals;<\/li>\n<li>the United States Court of Federal Claims; and<\/li>\n<li>the district courts of Guam, the Virgin Islands, and the Northern Mariana Islands.<\/li>\n<\/ul>\n<p>(b) <strong>To Cases and Proceedings<\/strong>. These rules apply in:<\/p>\n<ul>\n<li>civil cases and proceedings, including bankruptcy, admiralty, and maritime cases;<\/li>\n<li>criminal cases and proceedings; and<\/li>\n<li>contempt proceedings, except those in which the court may act summarily.<\/li>\n<\/ul>\n<p>(c) <strong>Rules on Privilege<\/strong>. The rules on privilege apply to all stages of a case or proceeding.<\/p>\n<p>(d) <strong>Exceptions<\/strong>. These rules \u2014 except for those on privilege \u2014 do not apply to the following:<\/p>\n<p style=\"padding-left: 30px;\">(1) the court\u2019s determination, under <a title=\"Rule 104 \u2013 Preliminary Questions\" href=\"https:\/\/www.rulesofevidence.org\/article-i\/rule-104\/\">Rule 104<\/a>(a), on a preliminary question of fact governing admissibility;<\/p>\n<p style=\"padding-left: 30px;\">(2) grand-jury proceedings; and<\/p>\n<p style=\"padding-left: 30px;\">(3) miscellaneous proceedings such as:<\/p>\n<ul>\n<li>extradition or rendition;<\/li>\n<li>issuing an arrest warrant, criminal summons, or search warrant;<\/li>\n<li>a preliminary examination in a criminal case;<\/li>\n<li>sentencing;<\/li>\n<li>granting or revoking probation or supervised release; and<\/li>\n<li>considering whether to release on bail or otherwise.<\/li>\n<\/ul>\n<p>(e) <strong>Other Statutes and Rules<\/strong>. A federal statute or a rule prescribed by the Supreme Court may provide for admitting or excluding evidence independently from these rules.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) To Courts and Judges.
