In a criminal case in which a defendant is accused of child molestation, the court may admit evidence that the defendant committed any other child molestation. The evidence may be considered on any matter to which it is relevant.<\/p>\n<p>(b) <strong>Disclosure to the Defendant<\/strong>. If the prosecutor intends to offer this evidence, the prosecutor must disclose it to the defendant, including witnesses\u2019 statements or a summary of the expected testimony. The prosecutor must do so at least 15 days before trial or at a later time that the court allows for good cause.<\/p>\n<p>(c) <strong>Effect on Other Rules<\/strong>. This rule does not limit the admission or consideration of evidence under any other rule.<\/p>\n<p>(d) <strong>Definition of \u201cChild\u201d and \u201cChild Molestation.\u201d<\/strong> In this rule and <a title=\"Rule 415 \u2013 Similar Acts in Civil Cases Involving Sexual Assault or Child Molestation\" href=\"https:\/\/www.rulesofevidence.org\/article-iv\/rule-415\/\">Rule 415<\/a>:<\/p>\n<p style=\"padding-left: 30px;\">(1) \u201cchild\u201d means a person below the age of 14; and<\/p>\n<p style=\"padding-left: 30px;\">(2) \u201cchild molestation\u201d means a crime under federal law or under state law (as \u201cstate\u201d is defined in 18 U.S.C. \u00a7 513) involving:<\/p>\n<p style=\"padding-left: 60px;\">(A) any conduct prohibited by 18 U.S.C. chapter 109A and committed with a child;<\/p>\n<p style=\"padding-left: 60px;\">(B) any conduct prohibited by 18 U.S.C. chapter 110;<\/p>\n<p style=\"padding-left: 60px;\">(C) contact between any part of the defendant\u2019s body \u2014 or an object \u2014 and a child\u2019s genitals or anus;<\/p>\n<p style=\"padding-left: 60px;\">(D) contact between the defendant\u2019s genitals or anus and any part of a child\u2019s body;<\/p>\n<p style=\"padding-left: 60px;\">(E) deriving sexual pleasure or gratification from inflicting death, bodily injury, or physical pain on a child; or<\/p>\n<p style=\"padding-left: 60px;\">(F) an attempt or conspiracy to engage in conduct described in subparagraphs (A)\u2013(E).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) Permitted Uses.
