Evidence of a person\u2019s character or character trait is not admissible to prove that on a particular occasion the person acted in accordance with the character or trait.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #000000; font-size: 14pt;\">(2) <em>Exceptions for a Defendant or Victim in a Criminal Case<\/em>. The following exceptions apply in a criminal case:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"color: #000000; font-size: 14pt;\">(A) a defendant may offer evidence of the defendant\u2019s pertinent trait, and if the evidence is admitted, the prosecutor may offer evidence to rebut it;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"color: #000000; font-size: 14pt;\">(B) subject to the limitations in <a style=\"color: #000000;\" title=\"Rule 412 \u2013 Sex-Offense Cases: The Victim\u2019s Sexual Behavior or Predisposition\" href=\"https:\/\/www.rulesofevidence.org\/article-iv\/rule-412\/\">Rule 412<\/a>, a defendant may offer evidence of an alleged victim\u2019s pertinent trait, and if the evidence is admitted, the prosecutor may:<\/span><\/p>\n<p style=\"padding-left: 90px;\"><span style=\"color: #000000; font-size: 14pt;\">(i) offer evidence to rebut it; and<\/span><\/p>\n<p style=\"padding-left: 90px;\"><span style=\"color: #000000; font-size: 14pt;\">(ii) offer evidence of the defendant\u2019s same trait; and<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"color: #000000; font-size: 14pt;\">(C) in a homicide case, the prosecutor may offer evidence of the alleged victim\u2019s trait of peacefulness to rebut evidence that the victim was the first aggressor.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #000000; font-size: 14pt;\">(3) <em>Exceptions for a Witness<\/em>. Evidence of a witness\u2019s character may be admitted under <a style=\"color: #000000;\" title=\"Rule 607 \u2013 Who May Impeach a Witness\" href=\"https:\/\/www.rulesofevidence.org\/article-vi\/rule-607\/\">Rules 607<\/a>, <a style=\"color: #000000;\" title=\"Rule 608 \u2013 A Witness\u2019s Character for Truthfulness or Untruthfulness\" href=\"https:\/\/www.rulesofevidence.org\/article-vi\/rule-608\/\">608<\/a>, and <a style=\"color: #000000;\" title=\"Rule 609 \u2013 Impeachment by Evidence of a Criminal Conviction\" href=\"https:\/\/www.rulesofevidence.org\/article-vi\/rule-609\/\">609<\/a>.<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 14pt;\">(b) <strong>Crimes, Wrongs, or Other Acts<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #000000; font-size: 14pt;\">(1) <em>Prohibited Uses<\/em>. Evidence of a crime, wrong, or other act is not admissible to prove a person\u2019s character in order to show that on a particular occasion the person acted in accordance with the character.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #000000; font-size: 14pt;\">(2) <em>Permitted Uses; Notice in a Criminal Case<\/em>. This evidence may be admissible for another purpose, such as proving motive, opportunity, intent, preparation, plan, knowledge, identity, absence of mistake, or lack of accident. On request by a defendant in a criminal case, the prosecutor must:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"color: #000000; font-size: 14pt;\">(A) provide reasonable notice of the general nature of any such evidence that the prosecutor intends to offer at trial; and<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"color: #000000; font-size: 14pt;\">(B) do so before trial \u2014 or during trial if the court, for good cause, excuses lack of pretrial notice.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0\u00a0\u00a0\u00a0 This page is continued from Federal Rules of Evidence\u00a0 Simplified: *********************** (a) Character Evidence.
