{"id":4436,"date":"2017-08-10T03:48:28","date_gmt":"2017-08-10T03:48:28","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4436"},"modified":"2017-08-14T01:56:21","modified_gmt":"2017-08-14T01:56:21","slug":"rule-77-conducting-business-clerks-authority-notice-of-an-order-or-judgment","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4436","title":{"rendered":"Rule 77 \u2013 Conducting Business; Clerk\u2019s Authority; Notice of an Order or Judgment"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">(a)\u00a0<strong>When Court Is Open<\/strong>.\u00a0Every district court is considered always open for filing any paper, issuing and returning process, making a motion, or entering an order.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b)\u00a0<strong>Place for Trial and Other Proceedings<\/strong>.\u00a0Every trial on the merits must be conducted in open court and, so far as convenient, in a regular courtroom. Any other act or proceeding may be done or conducted by a judge in chambers, without the attendance of the clerk or other court official, and anywhere inside or outside the district. But no hearing\u2014other than one ex parte\u2014may be conducted outside the district unless all the affected parties consent.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c)\u00a0<strong>Clerk\u2019s Office Hours; Clerk\u2019s Orders<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>Hours.<\/em>\u00a0The clerk\u2019s office\u2014with a clerk or deputy on duty\u2014must be open during business hours every day except Saturdays, Sundays, and legal holidays. But a court may, by local rule or order, require that the office be open for specified hours on Saturday or a particular legal holiday other than one listed in <a title=\"Rule 6 \u2013 Computing and Extending Time; Time for Motion Papers\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-ii-commencing-an-action-service-of-process-pleadings-motions-and-orders\/rule-6-computing-and-extending-time-time-for-motion-papers\/\">Rule 6(a)(6)(A)<\/a>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>Orders.<\/em>\u00a0Subject to the court\u2019s power to suspend, alter, or rescind the clerk\u2019s action for good cause, the clerk may:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) issue process;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) enter a default;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(C) enter a default judgment under <a title=\"Rule 55 \u2013 Default; Default Judgment\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-55-default-default-judgment\/\">Rule 55(b)(1)<\/a>; and<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(D) act on any other matter that does not require the court\u2019s action.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(d)\u00a0<strong>Serving Notice of an Order or Judgment<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>Service.<\/em>\u00a0Immediately after entering an order or judgment, the clerk must serve notice of the entry, as provided in\u00a0<a title=\"Rule 5 \u2013 Serving and Filing Pleadings and Other Papers\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-ii-commencing-an-action-service-of-process-pleadings-motions-and-orders\/rule-5-serving-and-filing-pleadings-and-other-papers\/\">Rule 5(b)<\/a>, on each party who is not in default for failing to appear. The clerk must record the service on the docket. A party also may serve notice of the entry as provided in\u00a0<a title=\"Rule 5 \u2013 Serving and Filing Pleadings and Other Papers\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-ii-commencing-an-action-service-of-process-pleadings-motions-and-orders\/rule-5-serving-and-filing-pleadings-and-other-papers\/\">Rule 5(b)<\/a>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>Time to Appeal Not Affected by Lack of Notice.<\/em>\u00a0Lack of notice of the entry does not affect the time for appeal or relieve\u2014or authorize the court to relieve\u2014a party for failing to appeal within the time allowed, except as allowed by\u00a0Federal Rule of Appellate Procedure\u00a0(4)(a).<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a)\u00a0When Court Is Open.\u00a0Every district court is considered always open for filing any paper, issuing and returning process, making a motion, or entering an order.
