{"id":4396,"date":"2017-08-10T03:05:07","date_gmt":"2017-08-10T03:05:07","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4396"},"modified":"2017-08-13T21:45:07","modified_gmt":"2017-08-13T21:45:07","slug":"rule-59-new-trial-altering-or-amending-a-judgment","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4396","title":{"rendered":"Rule 59 \u2013 New Trial; Altering or Amending a Judgment"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">(a)\u00a0<strong>In General<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>Grounds for New Trial.<\/em>\u00a0The court may, on motion, grant a new trial on all or some of the issues\u2014and to any party\u2014as follows:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) after a jury trial, for any reason for which a new trial has heretofore been granted in an action at law in federal court; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) after a nonjury trial, for any reason for which a rehearing has heretofore been granted in a suit in equity in federal court.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>Further Action After a Nonjury Trial.<\/em>\u00a0After a nonjury trial, the court may, on motion for a new trial, open the judgment if one has been entered, take additional testimony, amend findings of fact and conclusions of law or make new ones, and direct the entry of a new judgment.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b)\u00a0<strong>Time to File a Motion for a New Trial<\/strong>.\u00a0A motion for a new trial must be filed no later than 28 days after the entry of judgment.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c)\u00a0<strong>Time to Serve Affidavits<\/strong>.\u00a0When a motion for a new trial is based on affidavits, they must be filed with the motion. The opposing party has 14 days after being served to file opposing affidavits. The court may permit reply affidavits.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(d)\u00a0<strong>New Trial on the Court\u2019s Initiative or for Reasons Not in the Motion<\/strong>.\u00a0No later than 28 days after the entry of judgment, the court, on its own, may order a new trial for any reason that would justify granting one on a party\u2019s motion. After giving the parties notice and an opportunity to be heard, the court may grant a timely motion for a new trial for a reason not stated in the motion. In either event, the court must specify the reasons in its order.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(e)\u00a0<strong>Motion to Alter or Amend a Judgment<\/strong>.\u00a0A motion to alter or amend a judgment must be filed no later than 28 days after the entry of the judgment.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a)\u00a0In General.
