{"id":4394,"date":"2017-08-10T03:04:05","date_gmt":"2017-08-10T03:04:05","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4394"},"modified":"2017-08-13T21:44:20","modified_gmt":"2017-08-13T21:44:20","slug":"rule-58-entering-judgment","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4394","title":{"rendered":"Rule 58 \u2013 Entering Judgment"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">(a)\u00a0<strong>Separate Document<\/strong>.\u00a0Every judgment and amended judgment must be set out in a separate document, but a separate document is not required for an order disposing of a motion:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) for judgment under\u00a0<a title=\"Rule 50 \u2013 Judgment as a Matter of Law in a Jury Trial; Related Motion for a New Trial; Conditional Ruling\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vi-trials\/rule-50-judgment-as-a-matter-of-law-in-a-jury-trial-related-motion-for-a-new-trial-conditional-ruling\/\">Rule 50(b)<\/a>;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) to amend or make additional findings under\u00a0<a title=\"Rule 52 \u2013 Findings and Conclusions by the Court; Judgment on Partial Findings\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vi-trials\/rule-52-findings-and-conclusions-by-the-court-judgment-on-partial-findings\/\">Rule 52(b)<\/a>;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(3) for attorney\u2019s fees under\u00a0<a title=\"Rule 54 \u2013 Judgment; Costs\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-54-judgment-costs\/\">Rule 54<\/a>;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(4) for a new trial, or to alter or amend the judgment, under\u00a0<a title=\"Rule 59 \u2013 New Trial; Altering or Amending a Judgment\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-59-new-trial-altering-or-amending-a-judgment\/\">Rule 59<\/a>; or<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(5) for relief under\u00a0<a title=\"Rule 60 \u2013 Relief from a Judgment or Order\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-60-relief-from-a-judgment-or-order\/\">Rule 60<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b)\u00a0<strong>Entering Judgment<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>Without the Court\u2019s Direction.<\/em>\u00a0Subject to\u00a0<a title=\"Rule 54 \u2013 Judgment; Costs\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-54-judgment-costs\/\">Rule 54(b)<\/a>\u00a0and unless the court orders otherwise, the clerk must, without awaiting the court\u2019s direction, promptly prepare, sign, and enter the judgment when:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) the jury returns a general verdict;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) the court awards only costs or a sum certain; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(C) the court denies all relief.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>Court\u2019s Approval Required.<\/em>\u00a0Subject to\u00a0<a title=\"Rule 54 \u2013 Judgment; Costs\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-54-judgment-costs\/\">Rule 54(b)<\/a>, the court must promptly approve the form of the judgment, which the clerk must promptly enter, when:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) the jury returns a special verdict or a general verdict with answers to written questions; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) the court grants other relief not described in this subdivision (b).<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c)\u00a0<strong>Time of Entry<\/strong>.\u00a0For purposes of these rules, judgment is entered at the following times:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) if a separate document is not required, when the judgment is entered in the civil docket under\u00a0<a title=\"Rule 79 \u2013 Records Kept by the Clerk\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-x-district-courts-and-clerks-conducting-busines-issuing-orders\/rule-79-records-kept-by-the-clerk\/\">Rule 79(a)<\/a>; or<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) if a separate document is required, when the judgment is entered in the civil docket under\u00a0<a title=\"Rule 79 \u2013 Records Kept by the Clerk\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-x-district-courts-and-clerks-conducting-busines-issuing-orders\/rule-79-records-kept-by-the-clerk\/\">Rule 79(a)<\/a>\u00a0and the earlier of these events occurs:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) it is set out in a separate document; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) 150 days have run from the entry in the civil docket.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(d)\u00a0<strong>Request for Entry<\/strong>.\u00a0A party may request that judgment be set out in a separate document as required by\u00a0Rule 58(a).<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(e)\u00a0<strong>Cost or Fee Awards<\/strong>.\u00a0Ordinarily, the entry of judgment may not be delayed, nor the time for appeal extended, in order to tax costs or award fees.
