{"id":4380,"date":"2017-08-10T02:29:13","date_gmt":"2017-08-10T02:29:13","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4380"},"modified":"2017-08-13T21:22:32","modified_gmt":"2017-08-13T21:22:32","slug":"rule-52-findings-and-conclusions-by-the-court-judgment-on-partial-findings","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4380","title":{"rendered":"Rule 52 \u2013 Findings and Conclusions by the Court; Judgment on Partial Findings"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">(a)\u00a0<strong>Findings and Conclusions<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>In General.<\/em>\u00a0In an action tried on the facts without a jury or with an advisory jury, the court must find the facts specially and state its conclusions of law separately. The findings and conclusions may be stated on the record after the close of the evidence or may appear in an opinion or a memorandum of decision filed by the court. Judgment must be entered under\u00a0<a title=\"Rule 58 \u2013 Entering Judgment\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-58-entering-judgment\/\">Rule 58<\/a>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>For an Interlocutory Injunction.<\/em>\u00a0In granting or refusing an interlocutory injunction, the court must similarly state the findings and conclusions that support its action.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(3)\u00a0<em>For a Motion.<\/em>\u00a0The court is not required to state findings or conclusions when ruling on a motion under\u00a0<a title=\"Rule 12 \u2013 Defenses and Objections: When and How Presented; Motion for Judgment on the Pleadings; Consolidating Motions; Waiving Defenses; Pretrial Hearing\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-iii-pleadings-and-motions\/rule-12-defenses-and-objections-when-and-how-presented-motion-for-judgment-on-the-pleadings-consolidating-motions-waiving-defenses-pretrial-hearing\/\">Rule 12<\/a>\u00a0or\u00a0<a title=\"Rule 56 \u2013 Summary Judgment\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-56-summary-judgment\/\">56<\/a>\u00a0or, unless these rules provide otherwise, on any other motion.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(4)\u00a0<em>Effect of a Master\u2019s Findings.<\/em>\u00a0A master\u2019s findings, to the extent adopted by the court, must be considered the court\u2019s findings.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(5)\u00a0<em>Questioning the Evidentiary Support.<\/em>\u00a0A party may later question the sufficiency of the evidence supporting the findings, whether or not the party requested findings, objected to them, moved to amend them, or moved for partial findings.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(6)\u00a0<em>Setting Aside the Findings.<\/em>\u00a0Findings of fact, whether based on oral or other evidence, must not be set aside unless clearly erroneous, and the reviewing court must give due regard to the trial court\u2019s opportunity to judge the witnesses\u2019 credibility.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b)\u00a0<strong>Amended or Additional Findings<\/strong>.\u00a0On a party\u2019s motion filed no later than 28 days after the entry of judgment, the court may amend its findings\u2014or make additional findings\u2014and may amend the judgment accordingly. The motion may accompany a motion for a new trial under\u00a0<a title=\"Rule 59 \u2013 New Trial; Altering or Amending a Judgment\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vii-judgment\/rule-59-new-trial-altering-or-amending-a-judgment\/\">Rule 59<\/a>.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c)\u00a0<strong>Judgment on Partial Findings<\/strong>.\u00a0If a party has been fully heard on an issue during a nonjury trial and the court finds against the party on that issue, the court may enter judgment against the party on a claim or defense that, under the controlling law, can be maintained or defeated only with a favorable finding on that issue. The court may, however, decline to render any judgment until the close of the evidence. A judgment on partial findings must be supported by findings of fact and conclusions of law as required by\u00a0Rule 52(a).<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a)\u00a0Findings and Conclusions.
