{"id":4378,"date":"2017-08-10T02:10:06","date_gmt":"2017-08-10T02:10:06","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4378"},"modified":"2017-08-13T21:21:43","modified_gmt":"2017-08-13T21:21:43","slug":"rule-51-instructions-to-the-jury-objections-preserving-a-claim-of-error","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4378","title":{"rendered":"Rule 51 \u2013 Instructions to the Jury; Objections; Preserving a Claim of Error"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\">(a)\u00a0<strong>Requests<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>Before or at the Close of the Evidence.<\/em>\u00a0At the close of the evidence or at any earlier reasonable time that the court orders, a party may file and furnish to every other party written requests for the jury instructions it wants the court to give.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>After the Close of the Evidence.<\/em>\u00a0After the close of the evidence, a party may:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) file requests for instructions on issues that could not reasonably have been anticipated by an earlier time that the court set for requests; and<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) with the court\u2019s permission, file untimely requests for instructions on any issue.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(b)\u00a0<strong>Instructions<\/strong>.\u00a0The court:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1) must inform the parties of its proposed instructions and proposed action on the requests before instructing the jury and before final jury arguments;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2) must give the parties an opportunity to object on the record and out of the jury\u2019s hearing before the instructions and arguments are delivered; and<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(3) may instruct the jury at any time before the jury is discharged.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(c)\u00a0<strong>Objections<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>How to Make.<\/em>\u00a0A party who objects to an instruction or the failure to give an instruction must do so on the record, stating distinctly the matter objected to and the grounds for the objection.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>When to Make.<\/em>\u00a0An objection is timely if:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) a party objects at the opportunity provided under\u00a0Rule 51(b)(2); or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) a party was not informed of an instruction or action on a request before that opportunity to object, and the party objects promptly after learning that the instruction or request will be, or has been, given or refused.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">(d)\u00a0<strong>Assigning Error; Plain Error<\/strong>.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(1)\u00a0<em>Assigning Error.<\/em>\u00a0A party may assign as error:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(A) an error in an instruction actually given, if that party properly objected; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\">(B) a failure to give an instruction, if that party properly requested it and\u2014unless the court rejected the request in a definitive ruling on the record\u2014also properly objected.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\">(2)\u00a0<em>Plain Error.<\/em>\u00a0A court may consider a plain error in the instructions that has not been preserved as required by\u00a0Rule 51(d)(1)\u00a0if the error affects substantial rights.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a)\u00a0Requests.
