{"id":4305,"date":"2017-08-09T18:57:09","date_gmt":"2017-08-09T18:57:09","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4305"},"modified":"2017-08-13T21:04:07","modified_gmt":"2017-08-13T21:04:07","slug":"rule-41-dismissal-of-actions","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4305","title":{"rendered":"Rule 41 \u2013 Dismissal of Actions"},"content":{"rendered":"<p>(a)\u00a0<strong>Voluntary Dismissal<\/strong>.<\/p>\n<p style=\"padding-left: 30px;\">(1)\u00a0<em>By the Plaintiff.<\/em><\/p>\n<p style=\"padding-left: 60px;\">(A)\u00a0<em>Without a Court Order.<\/em>\u00a0Subject to <a title=\"Rule 23 \u2013 Class Actions\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-iv-parties\/rule-23-class-actions\/\">Rules\u00a023(e)<\/a>,\u00a0<a title=\"Rule 23.1 \u2013 Derivative Actions\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-iv-parties\/rule-23-1-derivative-actions\/\">23.1(c)<\/a>,\u00a0<a title=\"Rule 23.2 \u2013 Actions Relating to Unincorporated Associations\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-iv-parties\/rule-23-2-actions-relating-to-unincorporated-associations\/\">23.2<\/a>, and\u00a0<a title=\"Rule 66 \u2013 Receivers\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-viii-provisional-and-final-remedies\/rule-66-receivers\/\">66<\/a>\u00a0and any applicable federal statute, the plaintiff may dismiss an action without a court order by filing:<\/p>\n<p style=\"padding-left: 90px;\">(i) a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment; or<\/p>\n<p style=\"padding-left: 90px;\">(ii) a stipulation of dismissal signed by all parties who have appeared.<\/p>\n<p style=\"padding-left: 60px;\">(B)\u00a0<em>Effect.<\/em>\u00a0Unless the notice or stipulation states otherwise, the dismissal is without prejudice. But if the plaintiff previously dismissed any federal- or state-court action based on or including the same claim, a notice of dismissal operates as an adjudication on the merits.<\/p>\n<p style=\"padding-left: 30px;\">(2)\u00a0<em>By Court Order; Effect.<\/em>\u00a0Except as provided in\u00a0<a title=\"Rule 41 \u2013 Dismissal of Actions\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vi-trials\/rule-41-dismissal-of-actions\/\">Rule 41(a)(1)<\/a>, an action may be dismissed at the plaintiff\u2019s request only by court order, on terms that the court considers proper. If a defendant has pleaded a counterclaim before being served with the plaintiff\u2019s motion to dismiss, the action may be dismissed over the defendant\u2019s objection only if the counterclaim can remain pending for independent adjudication. Unless the order states otherwise, a dismissal under this paragraph (2) is without prejudice.<\/p>\n<p>(b)\u00a0<strong>Involuntary Dismissal; Effect<\/strong>.\u00a0If the plaintiff fails to prosecute or to comply with these rules or a court order, a defendant may move to dismiss the action or any claim against it. Unless the dismissal order states otherwise, a dismissal under this subdivision (b) and any dismissal not under this rule\u2014except one for lack of jurisdiction, improper venue, or failure to join a party under\u00a0<a title=\"Rule 19 \u2013 Required Joinder of Parties\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-iv-parties\/rule-19-required-joinder-of-parties\/\">Rule 19<\/a>\u2014operates as an adjudication on the merits.<\/p>\n<p>(c)\u00a0<strong>Dismissing a Counterclaim, Crossclaim, or Third-Party Claim<\/strong>.\u00a0This rule applies to a dismissal of any counterclaim, crossclaim, or third-party claim. A claimant\u2019s voluntary dismissal under <a title=\"Rule 41 \u2013 Dismissal of Actions\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-vi-trials\/rule-41-dismissal-of-actions\/\">Rule 41(a)(1)(A)(i)<\/a>\u00a0must be made:<\/p>\n<p style=\"padding-left: 30px;\">(1) before a responsive pleading is served; or<\/p>\n<p style=\"padding-left: 30px;\">(2) if there is no responsive pleading, before evidence is introduced at a hearing or trial.<\/p>\n<p>(d)\u00a0<strong>Costs of a Previously Dismissed Action<\/strong>.\u00a0If a plaintiff who previously dismissed an action in any court files an action based on or including the same claim against the same defendant, the court:<\/p>\n<p style=\"padding-left: 30px;\">(1) may order the plaintiff to pay all or part of the costs of that previous action; and<\/p>\n<p style=\"padding-left: 30px;\">(2) may stay the proceedings until the plaintiff has complied.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a)\u00a0Voluntary Dismissal.
