{"id":4253,"date":"2017-08-09T01:34:04","date_gmt":"2017-08-09T01:34:04","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4253"},"modified":"2017-08-13T20:21:05","modified_gmt":"2017-08-13T20:21:05","slug":"rule-28-persons-before-whom-depositions-may-be-taken","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4253","title":{"rendered":"Rule 28 \u2013 Persons Before Whom Depositions May Be Taken"},"content":{"rendered":"<p>(a)\u00a0<strong>Within the United States<\/strong>.<\/p>\n<p style=\"padding-left: 30px;\">(1)\u00a0<em>In General.<\/em>\u00a0Within the United States or a territory or insular possession subject to United States jurisdiction, a deposition must be taken before:<\/p>\n<p style=\"padding-left: 60px;\">(A) an officer authorized to administer oaths either by federal law or by the law in the place of examination; or<\/p>\n<p style=\"padding-left: 60px;\">(B) a person appointed by the court where the action is pending to administer oaths and take testimony.<\/p>\n<p style=\"padding-left: 30px;\">(2)\u00a0<em>Definition of \u201cOfficer.\u201d<\/em>\u00a0The term \u201cofficer\u201d in <a title=\"Rule 30 \u2013 Depositions by Oral Examination\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-v-disclosures-and-discovery\/rule-30-depositions-by-oral-examination\/\">Rules\u00a030<\/a>,\u00a0<a title=\"Rule 31 \u2013 Depositions by Written Questions\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-v-disclosures-and-discovery\/rule-31-depositions-by-written-questions\/\">31<\/a>, and\u00a0<a title=\"Rule 32 \u2013 Using Depositions in Court Proceedings\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-v-disclosures-and-discovery\/rule-32-using-depositions-in-court-proceedings\/\">32<\/a>\u00a0includes a person appointed by the court under this rule or designated by the parties under\u00a0<a title=\"Rule 29 \u2013 Stipulations About Discovery Procedure\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-v-disclosures-and-discovery\/rule-29-stipulations-about-discovery-procedure\/\">Rule 29(a)<\/a>.<\/p>\n<p>(b)\u00a0<strong>In a Foreign Country<\/strong>.<\/p>\n<p style=\"padding-left: 30px;\">(1)\u00a0<em>In General.<\/em>\u00a0A deposition may be taken in a foreign country:<\/p>\n<p style=\"padding-left: 60px;\">(A) under an applicable treaty or convention;<\/p>\n<p style=\"padding-left: 60px;\">(B) under a letter of request, whether or not captioned a \u201cletter rogatory\u201d;<\/p>\n<p style=\"padding-left: 60px;\">(C) on notice, before a person authorized to administer oaths either by federal law or by the law in the place of examination; or<\/p>\n<p style=\"padding-left: 60px;\">(D) before a person commissioned by the court to administer any necessary oath and take testimony.<\/p>\n<p style=\"padding-left: 30px;\">(2)\u00a0<em>Issuing a Letter of Request or a Commission.<\/em>\u00a0A letter of request, a commission, or both may be issued:<\/p>\n<p style=\"padding-left: 60px;\">(A) on appropriate terms after an application and notice of it; and<\/p>\n<p style=\"padding-left: 60px;\">(B) without a showing that taking the deposition in another manner is impracticable or inconvenient.<\/p>\n<p style=\"padding-left: 30px;\">(3)\u00a0<em>Form of a Request, Notice, or Commission.<\/em>\u00a0When a letter of request or any other device is used according to a treaty or convention, it must be captioned in the form prescribed by that treaty or convention. A letter of request may be addressed \u201cTo the Appropriate Authority in [name of country].\u201d A deposition notice or a commission must designate by name or descriptive title the person before whom the deposition is to be taken.<\/p>\n<p style=\"padding-left: 30px;\">(4)\u00a0<em>Letter of Request\u2014Admitting Evidence.<\/em>\u00a0Evidence obtained in response to a letter of request need not be excluded merely because it is not a verbatim transcript, because the testimony was not taken under oath, or because of any similar departure from the requirements for depositions taken within the United States.<\/p>\n<p>(c)\u00a0<strong>Disqualification<\/strong>.\u00a0A deposition must not be taken before a person who is any party\u2019s relative, employee, or attorney; who is related to or employed by any party\u2019s attorney; or who is financially interested in the action.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a)\u00a0Within the United States.
