{"id":4220,"date":"2017-08-09T00:04:06","date_gmt":"2017-08-09T00:04:06","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4220"},"modified":"2017-08-13T19:30:04","modified_gmt":"2017-08-13T19:30:04","slug":"rule-20-permissive-joinder-of-parties","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4220","title":{"rendered":"Rule 20 \u2013 Permissive Joinder of Parties"},"content":{"rendered":"<p>(a) P<strong>ersons Who May Join or Be Joined<\/strong>.<\/p>\n<p style=\"padding-left: 30px;\">(1) <em>Plaintiffs.<\/em> Persons may join in one action as plaintiffs if:<\/p>\n<p style=\"padding-left: 60px;\">(A) they assert any right to relief jointly, severally, or in the alternative with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences; and<\/p>\n<p style=\"padding-left: 60px;\">(B) any question of law or fact common to all plaintiffs will arise in the action.<\/p>\n<p style=\"padding-left: 30px;\">(2) <em>Defendants.<\/em> Persons\u2014as well as a vessel, cargo, or other property subject to admiralty process in rem\u2014may be joined in one action as defendants if:<\/p>\n<p style=\"padding-left: 60px;\">(A) any right to relief is asserted against them jointly, severally, or in the alternative with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences; and<\/p>\n<p style=\"padding-left: 60px;\">(B) any question of law or fact common to all defendants will arise in the action.<\/p>\n<p style=\"padding-left: 30px;\">(3) <em>Extent of Relief.<\/em> Neither a plaintiff nor a defendant need be interested in obtaining or defending against all the relief demanded. The court may grant judgment to one or more plaintiffs according to their rights, and against one or more defendants according to their liabilities.<\/p>\n<p>(b) <strong>Protective Measures<\/strong>. The court may issue orders\u2014including an order for separate trials\u2014to protect a party against embarrassment, delay, expense, or other prejudice that arises from including a person against whom the party asserts no claim and who asserts no claim against the party.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) Persons Who May Join or Be Joined.
