{"id":4218,"date":"2017-08-09T00:02:45","date_gmt":"2017-08-09T00:02:45","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4218"},"modified":"2017-08-16T04:21:49","modified_gmt":"2017-08-16T04:21:49","slug":"rule-19-required-joinder-of-parties","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4218","title":{"rendered":"Rule 19 \u2013 Required Joinder of Parties"},"content":{"rendered":"<p><span style=\"font-size: 14pt; color: #800000;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(a) Persons Required to Be Joined if Feasible.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><strong>(1) <em>Required Party.<\/em><\/strong> A person who is subject to service of process and whose joinder will not deprive the court of <a href=\"https:\/\/reunitethestates.org\/\/?page_id=5206\"><strong>subject-matter jurisdiction<\/strong><\/a> must be joined as a party if:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(A) in that person\u2019s absence, the court cannot accord complete relief among existing parties; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(B) that person claims an interest relating to the subject of the action and is so situated that disposing of the action in the person\u2019s absence may:<\/span><\/p>\n<p style=\"padding-left: 90px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(i) as a practical matter impair or impede the person\u2019s ability to protect the interest; or<\/span><\/p>\n<p style=\"padding-left: 90px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(ii) leave an existing party subject to a substantial risk of incurring double, multiple, or otherwise inconsistent obligations because of the interest.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><strong>(2) <em>Joinder by Court Order.<\/em><\/strong> If a person has not been joined as required, the court must order that the person be made a party. A person who refuses to join as a plaintiff may be made either a defendant or, in a proper case, an involuntary plaintiff.<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><strong>(3) <em>Venue.<\/em><\/strong> If a joined party objects to venue and the joinder would make venue improper, the court must dismiss that party.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><strong><span style=\"color: #800000;\">(b) When Joinder Is Not Feasible.<\/span> <\/strong>If a person who is required to be joined if feasible cannot be joined, the court must determine whether, in equity and good conscience, the action should proceed among the existing parties or should be dismissed. The factors for the court to consider include:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(1) the extent to which a judgment rendered in the person\u2019s absence might prejudice that person or the existing parties;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(2) the extent to which any prejudice could be lessened or avoided by:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(A) protective provisions in the judgment;<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(B) shaping the relief; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(C) other measures;<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(3) whether a judgment rendered in the person\u2019s absence would be adequate; and<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(4) whether the plaintiff would have an adequate remedy if the action were dismissed for nonjoinder.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #800000;\"><strong>(c) Pleading the Reasons for Nonjoinder.<\/strong><\/span> When asserting a claim for relief, a party must state:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(1) the name, if known, of any person who is required to be joined if feasible but is not joined; and<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\">(2) the reasons for not joining that person.<\/span><\/p>\n<p><span style=\"font-size: 14pt; font-family: arial, helvetica, sans-serif;\"><span style=\"color: #800000;\"><strong>(d) Exception for Class Actions.<\/strong><\/span> This rule is subject to <a title=\"Rule 23 \u2013 Class Actions\" href=\"https:\/\/reunitethestates.org\/\/?page_id=4974\"><strong>Rule 23<\/strong><\/a>.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) Persons Required to Be Joined if Feasible.
