{"id":4196,"date":"2017-08-08T22:53:26","date_gmt":"2017-08-08T22:53:26","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4196"},"modified":"2017-08-13T19:13:50","modified_gmt":"2017-08-13T19:13:50","slug":"rule-13-counterclaim-and-crossclaim","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4196","title":{"rendered":"Rule 13 \u2013 Counterclaim and Crossclaim"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(a) <span style=\"color: #800000;\">Compulsory Counterclaim.<\/span><\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) <span style=\"color: #333333;\">In General.<\/span> A pleading must state as a counterclaim any claim that\u2014at the time of its service\u2014the pleader has against an opposing party if the claim:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) arises out of the transaction or occurrence that is the subject matter of the opposing party\u2019s claim; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) does not require adding another party over whom the court cannot acquire jurisdiction.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Exceptions.<\/span> The pleader need not state the claim if:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) when the action was commenced, the claim was the subject of another pending action; or<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) the opposing party sued on its claim by attachment or other process that did not establish personal jurisdiction over the pleader on that claim, and the pleader does not assert any counterclaim under this rule.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(b) <span style=\"color: #800000;\">Permissive Counterclaim.<\/span> A pleading may state as a counterclaim against an opposing party any claim that is not compulsory.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(c) <span style=\"color: #800000;\">Relief Sought in a Counterclaim.<\/span> A counterclaim need not diminish or defeat the recovery sought by the opposing party. It may request relief that exceeds in amount or differs in kind from the relief sought by the opposing party.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(d) <span style=\"color: #800000;\">Counterclaim Against the United States.<\/span> These rules do not expand the right to assert a counterclaim\u2014or to claim a credit\u2014against the United States or a United States officer or agency.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(e) <span style=\"color: #800000;\">Counterclaim Maturing or Acquired After Pleading.<\/span> The court may permit a party to file a supplemental pleading asserting a counterclaim that matured or was acquired by the party after serving an earlier pleading.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(f) <span style=\"color: #800000;\">[Abrogated. ]<\/span><\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(g) <span style=\"color: #800000;\">Crossclaim Against a Coparty.<\/span> A pleading may state as a crossclaim any claim by one party against a coparty if the claim arises out of the transaction or occurrence that is the subject matter of the original action or of a counterclaim, or if the claim relates to any property that is the subject matter of the original action. The crossclaim may include a claim that the coparty is or may be liable to the crossclaimant for all or part of a claim asserted in the action against the crossclaimant.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(h) <span style=\"color: #800000;\">Joining Additional Parties.<\/span> <span style=\"color: #800000;\">Rules 19<\/span> and<span style=\"color: #800000;\"> 20 <\/span>govern the addition of a person as a party to a counterclaim or crossclaim.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(i) <span style=\"color: #800000;\">Separate Trials; Separate Judgments.<\/span> If the court orders separate trials under<span style=\"color: #800000;\"> Rule 42(b)<\/span>, it may enter judgment on a counterclaim or crossclaim under <span style=\"color: #800000;\">Rule 54(b)\u00a0<\/span>when it has jurisdiction to do so, even if the opposing party\u2019s claims have been dismissed or otherwise resolved.<\/span><\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) Compulsory Counterclaim.
