{"id":4188,"date":"2017-08-08T22:21:40","date_gmt":"2017-08-08T22:21:40","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4188"},"modified":"2017-08-13T19:00:22","modified_gmt":"2017-08-13T19:00:22","slug":"rule-11-signing-pleadings-motions-and-other-papers-representations-to-the-court-sanctions","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4188","title":{"rendered":"Rule 11 \u2013 Signing Pleadings, Motions, and Other Papers; Representations to the Court; Sanctions"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(a) <span style=\"color: #800000;\">Signature.<\/span> Every pleading, written motion, and other paper must be signed by <em>at least one attorney of record<\/em> in the attorney\u2019s name\u2014<em>or by a party personally<\/em> if the party is unrepresented. <span style=\"color: #0000ff;\">The paper must state the signer\u2019s address, e-mail address, and telephone number.<\/span> Unless a rule or statute specifically states otherwise, a pleading need <em>not<\/em> be verified or accompanied by an affidavit. The court must strike an unsigned paper unless the omission is promptly corrected after being called to the attorney\u2019s or party\u2019s attention.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(b) <span style=\"color: #800000;\">Representations to the Court.<\/span> By presenting to the court a pleading, written motion, or other paper\u2014whether by signing, filing, submitting, or later advocating it\u2014an attorney or unrepresented party certifies that to the best of the person\u2019s knowledge, information, and belief, formed after an inquiry reasonable under the circumstances:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) it is not being presented for any improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) the claims, defenses, and other legal contentions are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(3) the factual contentions have evidentiary support or, if specifically so identified, will likely have evidentiary support after a reasonable opportunity for further investigation or discovery; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(4) the denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on belief or a lack of information.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(c) Sanctions.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) <span style=\"color: #800000;\">In General.<\/span> If, after notice and a reasonable opportunity to respond, the court determines that Rule 11(b) has been violated, the court may impose an appropriate sanction on any attorney, law firm, or party that violated the rule or is responsible for the violation. Absent exceptional circumstances, a law firm must be held jointly responsible for a violation committed by its partner, associate, or employee.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Motion for Sanctions.<\/span> A motion for sanctions must be made separately from any other motion and must describe the specific conduct that allegedly violates Rule 11(b). The motion must be served under <a title=\"Rule 5 \u2013 Serving and Filing Pleadings and Other Papers\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-ii-commencing-an-action-service-of-process-pleadings-motions-and-orders\/rule-5-serving-and-filing-pleadings-and-other-papers\/\">Rule 5<\/a>, but it must not be filed or be presented to the court if the challenged paper, claim, defense, contention, or denial is withdrawn or appropriately corrected within 21 days after service or within another time the court sets. If warranted, the court may award to the prevailing party the reasonable expenses, including attorney\u2019s fees, incurred for the motion.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(3) <span style=\"color: #800000;\">On the Court\u2019s Initiative.<\/span> On its own, the court may order an attorney, law firm, or party to show cause why conduct specifically described in the order has not violated Rule 11(b).<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(4) <span style=\"color: #800000;\">Nature of a Sanction.<\/span> A sanction imposed under this rule must be limited to what suffices to deter repetition of the conduct or comparable conduct by others similarly situated. The sanction may include nonmonetary directives; an order to pay a penalty into court; or, if imposed on motion and warranted for effective deterrence, an order directing payment to the movant of part or all of the reasonable attorney\u2019s fees and other expenses directly resulting from the violation.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(5) <span style=\"color: #800000;\">Limitations on Monetary Sanctions.<\/span> The court must not impose a monetary sanction:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) against a represented party for violating <span style=\"color: #800000;\">Rule 11(b)(2)<\/span>; or<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) on its own, unless it issued the show-cause order under <span style=\"color: #800000;\">Rule 11(c)(3)<\/span> before voluntary dismissal or settlement of the claims made by or against the party that is, or whose attorneys are, to be sanctioned.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(6) <span style=\"color: #800000;\">Requirements for an Order.<\/span> An order imposing a sanction must describe the sanctioned conduct and explain the basis for the sanction.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(d) <span style=\"color: #800000;\">Inapplicability to Discovery.<\/span> This rule does not apply to disclosures and discovery requests, responses, objections, and motions under Rules 26 through <a title=\"Rule 37 \u2013 Failure to Make Disclosures or to Cooperate in Discovery; Sanctions\" href=\"https:\/\/www.federalrulesofcivilprocedure.org\/frcp\/title-v-disclosures-and-discovery\/rule-37-failure-to-make-disclosures-or-to-cooperate-in-discovery-sanctions\/\">37<\/a>.<\/span><\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(a) Signature.
