{"id":4151,"date":"2017-08-08T20:00:16","date_gmt":"2017-08-08T20:00:16","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=4151"},"modified":"2017-08-13T17:51:59","modified_gmt":"2017-08-13T17:51:59","slug":"rule-8-general-rules-of-pleading","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=4151","title":{"rendered":"Rule 8 \u2013 General Rules of Pleading"},"content":{"rendered":"<div class=\"page\" title=\"Page 7\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(a) <span style=\"color: #800000;\">Claim for Relief.<\/span> A pleading that states a claim for relief must contain:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) a short and plain statement of the grounds for the court\u2019s jurisdiction, <em>unless<\/em> the court already has jurisdiction and the claim needs no new jurisdictional support;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) a short and plain statement of the claim showing that the pleader is entitled to <em>relief<\/em>; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(3) a demand for the relief sought, which may include relief in the alternative or different types of relief.<\/span><\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<div class=\"layoutArea\"><\/div>\n<\/div>\n<div class=\"page\" title=\"Page 8\">\n<div class=\"layoutArea\"><\/div>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(b)<span style=\"color: #800000;\"> Defenses; Admissions and Denials.<\/span><\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) In General. In responding to a pleading, a party must:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) state in <em>short and plain terms<\/em> its defenses to each claim asserted against it; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) admit or deny the allegations asserted against it by an opposing party.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Denials\u2014Responding to the Substance.<\/span> A denial must fairly respond to the <em>substance<\/em> of the allegation.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(3)<span style=\"color: #800000;\"> General and Specific Denials.<\/span> A party that intends in good faith to <em>deny<\/em> all the allegations of a pleading\u2014including the jurisdictional grounds \u2014 may do so by a general denial. A party that does <em>not<\/em> intend to deny all the allegations must either <span style=\"color: #0000ff;\">specifically deny designated allegations or generally deny all except those specifically admitted.<\/span><\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(4)<span style=\"color: #800000;\"> Denying Part of an Allegation.<\/span> A party that intends in good faith to deny only part of an allegation <em>must<\/em> admit the part that is true and deny the rest.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(5) <span style=\"color: #800000;\">Lacking Knowledge or Information.<\/span> A party that lacks knowledge or information sufficient to form a belief about the truth of an allegation must so state, and the statement has the effect of a denial.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(6) <span style=\"color: #800000;\">Effect of Failing to Deny.<\/span> An allegation\u2014other than one relating to the amount of damages\u2014is admitted if a responsive pleading is required and the allegation is <em>not<\/em> denied. If a responsive pleading is <em>not<\/em> required, an allegation is considered denied or avoided.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(c) <span style=\"color: #800000;\">Affirmative Defenses.<\/span><\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) In General. In responding to a pleading, a party must affirmatively state\u00a0<\/span><\/strong><\/span><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\"><em>any avoidance or affirmative defense<\/em>, including:<\/span><\/strong><\/span><\/p>\n<ul>\n<li style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">accord and satisfaction;<\/span><\/strong><\/span><\/span><\/li>\n<li style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><span style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">arbitration and award;<\/span><\/strong><\/span><\/span><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">assumption of risk;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">contributory negligence;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">duress;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">estoppel;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">failure of consideration;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">fraud;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">illegality;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">injury by fellow servant;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">laches;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">license;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">payment;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">release;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">res judicata;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">statute of frauds;<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">statute of limitations; and<\/span><\/strong><\/strong><\/li>\n<li style=\"padding-left: 60px;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">waiver.<\/span><\/strong><\/li>\n<\/ul>\n<p style=\"padding-left: 30px;\"><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Mistaken Designation.<\/span> If a party mistakenly designates a defense as a <em>counterclaim<\/em>, or a counterclaim as a <em>defense<\/em>, the court must, if justice requires, treat the pleading as though it were correctly designated, and may impose terms for doing so.<\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(d) <span style=\"color: #800000;\">Pleading to Be Concise and Direct; Alternative Statements; Inconsistency. <\/span><\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) In General. Each allegation must be simple, concise, and direct. No\u00a0<\/span><\/strong><\/span><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">technical form is required.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Alternative Statements of a Claim or Defense.<\/span> A party may set out 2 or more statements of a claim or defense alternatively or hypothetically, either in a single count or defense or in separate ones. If a party makes alternative statements, the pleading is sufficient if any one of them is sufficient.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(3) <span style=\"color: #800000;\">Inconsistent Claims or Defenses.<\/span> A party may state as many separate claims or defenses as it has, regardless of consistency.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(e) <span style=\"color: #800000;\">Construing Pleadings.<\/span> Pleadings must be construed so as to do justice.<\/span><\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 9\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>(a) Claim for Relief.
