\u00a0 \u00a0 Continued from Rule 4 – Summons<\/a>:<\/span><\/strong><\/span><\/p>\n

\n

(a)\u00a0In General.\u00a0Process\u2014 other than a\u00a0summons\u00a0<\/a>under\u00a0Rule 4<\/a>\u00a0or a subpoena under\u00a0subpoana under Rule 45<\/a>\u2014\u00a0must<\/em>\u00a0be served by a\u00a0United States marshal or deputy marshal<\/a>\u00a0or by a person specially appointed for that purpose. \u00a0It may be served anywhere within the territorial limits of the state where the district court is located and, if authorized by a\u00a0federal statute<\/a>, beyond those limits. \u00a0Proof of service must be made under\u00a0Rule 4(l<\/em>)<\/a>.<\/span><\/strong><\/p>\n

(b)\u00a0Enforcing Orders: Committing for Civil Contempt.\u00a0An\u00a0order<\/a>\u00a0committing a person for civil contempt of a decree or injunction issued to enforce federal law may be served and enforced in any\u00a0district<\/a>. \u00a0Any other\u00a0order<\/a>\u00a0in a civil-contempt proceeding may be served only in the state where the issuing court is located or elsewhere in the United States within 100 miles from where the order was issued.<\/span><\/strong><\/p>\n<\/div>\n

“<\/strong>(1884) The failure to obey a court order that was issued for another party’s benefit. \u00a0A civil-contempt proceeding is a coercive or remedial in nature. \u00a0The usual sanction is to confine the contemnor until he or she complies with the court order. \u00a0The act (or failure to act) complained of must be within the defendant’s power to \u00a0perform, & the contempt order must state how the contempt may be purged. \u00a0Imprisonment for civil contempt is indefinite & for a term that lasts until the defendant complies with the decree.”<\/strong><\/span><\/div>\n<\/div>\n
