Time for Motion Papers"},"content":{"rendered":"<div class=\"page\" title=\"Page 4\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(a) <span style=\"color: #800000;\">Computing Time.<\/span> The following rules apply in computing any time period specified in these rules, in any local rule or court order, or in any statute that does <em>not<\/em> specify a method of computing time.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) <span style=\"color: #800000;\">Period Stated in Days or a Longer Unit.<\/span> When the period is stated in days <em>or<\/em> a longer unit of time:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) <em>exclude<\/em> the day of the event that triggers the period;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B)<em> count every day<\/em>, including intermediate Saturdays, Sundays, and legal holidays; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(C) <em>include the last day of the period<\/em>, but if the last day is a <span style=\"color: #0000ff;\">Saturday, Sunday, or legal holiday<\/span>, the period continues to run until the end of the next day that is not a Saturday, Sunday, or legal holiday.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Period Stated in Hours.<\/span> When the period is stated in hours:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) begin counting <em>immediately<\/em> on the occurrence of the event that\u00a0<\/span><\/strong><\/span><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">triggers the period;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\"> (B) count <em>every hour<\/em>, including hours during intermediate Saturdays,\u00a0<\/span><\/strong><\/span><strong style=\"font-size: 14pt;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Sundays, and legal holidays; and<\/span><\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 5\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(C) if the period would end on a <span style=\"color: #0000ff;\">Saturday, Sunday, or legal holiday<\/span>, the period continues to run until the same time on the next day that is not a Saturday, Sunday, or legal holiday.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(3) <span style=\"color: #800000;\">Inaccessibility of the Clerk\u2019s Office.<\/span> Unless the court orders otherwise, if the clerk\u2019s office is inaccessible:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) on the last day for filing under <span style=\"color: #800000;\">Rule 6(a)(1)<\/span>, then the time for filing is <span style=\"color: #0000ff;\">extended to the first accessible day<\/span> that is <em>not<\/em> a Saturday, Sunday, or legal holiday; or<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) during the <em>last hour<\/em> for filing under <span style=\"color: #800000;\">Rule 6(a)(2)<\/span>, then the time for filing is extended to the <span style=\"color: #0000ff;\">same time on the first accessible day<\/span> that is <em>not<\/em> a Saturday, Sunday, or legal holiday.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(4) <span style=\"color: #800000;\">\u201cLast Day\u201d Defined.<\/span> Unless a different time is set by a statute, local rule, or court order, the last day ends:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) for electronic filing, <em>at midnight<\/em> in the court\u2019s time zone; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) for filing by other means, when the clerk\u2019s office is <em>scheduled to close<\/em>.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(5) <span style=\"color: #800000;\">\u201cNext Day\u201d Defined.<\/span> The \u201cnext day\u201d is determined by continuing to count <em>forward<\/em> when the period is measured <em>after an event<\/em> and <em>backward<\/em> when measured <em>before an event<\/em>.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(6) <span style=\"color: #800000;\">\u201cLegal Holiday\u201d Defined.<\/span> \u201cLegal holiday\u201d means:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) the day set aside by statute for observing New Year\u2019s Day, Martin Luther King Jr.\u2019s Birthday, Washington\u2019s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans\u2019 Day, Thanksgiving Day, or Christmas Day;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) any day declared a holiday by the President or Congress; and<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(C) for periods that are measured after an event, any other day declared a holiday by the state <em>where the district court is located.<\/em><\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(b) Extending Time.<br \/>\n<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) <span style=\"color: #800000;\">In General.<\/span> When an act may or must be done within a specified time,\u00a0<\/span><\/strong><\/span><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">the court may, for good cause, extend the time:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) with or without motion or notice <em>if the court acts<\/em>, or <em>if a request is made<\/em>, before the original time or its extension expires; or<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) on motion made after the time has <em>expired<\/em> if the party failed to act because of <em>excusable neglect<\/em>.<\/span><\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 6\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\"> (2) <span style=\"color: #800000;\">Exceptions.<\/span> A court must <em>not<\/em> extend the time to act under Rules 50(b)\u00a0<\/span><\/strong><\/span><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">and (d), 52(b), 59(b), (d), and (e), and 60(b). <\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(c) Motions, Notices of Hearing, and Affidavits.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(1) <span style=\"color: #800000;\">In General.<\/span> A written motion and notice of the hearing must be served <em>at least 14 days<\/em> before the time specified for the hearing, with the following exceptions:<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(A) when the motion may be heard <em>ex parte<\/em>;<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(B) when these rules set <em>a different time<\/em>; or<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(C) when a<em> court order<\/em>\u2014which a party may, for good cause, apply for ex parte\u2014sets a different time.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(2) <span style=\"color: #800000;\">Supporting Affidavit.<\/span> Any affidavit supporting a motion <em>must<\/em> be served with the motion. Except as <span style=\"color: #800000;\">Rule 59(c)<\/span> provides otherwise, any opposing affidavit <em>must<\/em> be served <em>at least 7 days<\/em> before the hearing, unless the court permits service at another time.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\">(d) <span style=\"color: #800000;\">Additional Time After Certain Kinds of Service.<\/span> When a party may or must act within a specified time after being served and service is made<\/span><\/strong><\/span><br \/>\n<span style=\"font-size: 14pt;\"><strong><span style=\"font-family: arial, helvetica, sans-serif;\"> under <span style=\"color: #800000;\">Rule 5(b)(2)(C)<\/span> (mail), <span style=\"color: #800000;\">(D)<\/span> (leaving with the clerk), or <span style=\"color: #800000;\">(F)<\/span> (other means consented to), 3 days are added after the period would otherwise expire under <span style=\"color: #800000;\">Rule 6(a)<\/span>.<\/span><\/strong><\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>(a) Computing Time.
