{"id":3961,"date":"2017-08-06T19:58:55","date_gmt":"2017-08-06T19:58:55","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=3961"},"modified":"2018-01-15T19:56:12","modified_gmt":"2018-01-15T19:56:12","slug":"rule-5-1-constitutional-challenge-to-a-statute","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=3961","title":{"rendered":"Rule 5.1\u2013 Constitutional Challenge to a Statute"},"content":{"rendered":"<p><strong><span style=\"font-size: 14pt;\">\u00a0\u00a0\u00a0\u00a0 This page is continued from <a href=\"https:\/\/reunitethestates.org\/?page_id=3901\" target=\"_blank\" rel=\"noopener\">Federal Rules of Civil Procedure <span style=\"text-decoration: underline;\"><em>Simplified<\/em><\/span><\/a> &gt;&gt;&gt;&gt; <a href=\"https:\/\/reunitethestates.org\/?page_id=3905\" target=\"_blank\" rel=\"noopener\">Title II\u2013 Commencing an Action; Service of Process; Pleadings, Motions, &amp; Orders<\/a> &gt;&gt;&gt;&gt; <a href=\"https:\/\/reunitethestates.org\/?page_id=3959\" target=\"_blank\" rel=\"noopener\">Rule 5- Serving and Filing Pleadings and Other Papers<\/a>:<\/span><\/strong><\/p>\n<p style=\"text-align: center;\">******************************<\/p>\n<p><span style=\"font-size: 14pt;\"><strong>(a)\u00a0<em>Notice by a Party<\/em>.<\/strong> A party that files a <a href=\"https:\/\/reunitethestates.org\/?page_id=5154\" target=\"_blank\" rel=\"noopener\">pleading<\/a>, written <a href=\"https:\/\/reunitethestates.org\/?page_id=4014\" target=\"_blank\" rel=\"noopener\">motion<\/a>, or other paper drawing into question the constitutionality of a federal or state statute must promptly:<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"> (1) file a notice of constitutional question stating the question and identifying the paper that raises it, if:<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"> (A) a federal statute is questioned and the parties do not include the United States, one of its agencies, or one of its officers or employees in an official capacity; or<\/span><\/p>\n<p style=\"padding-left: 60px;\"><span style=\"font-size: 14pt;\"> (B) a state statute is questioned and the parties do not include the state, one of its agencies, or one of its officers or employees in an official capacity; and<\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 14pt;\"> (2) serve the <a href=\"https:\/\/reunitethestates.org\/?page_id=10533\" target=\"_blank\" rel=\"noopener\">notice<\/a> and paper on the Attorney General of the United States if a federal statute is questioned\u2014or on the state attorney general if a state statute is questioned\u2014either by certified or registered mail or by sending it to an electronic address designated by the attorney general for this purpose.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong> (b)\u00a0<em>Certification by the Court<\/em>.<\/strong> The court must, under\u00a0<a href=\"http:\/\/uscode.house.gov\/view.xhtml?req=(title:28%20section:2403%20edition:prelim)%20OR%20(granuleid:USC-prelim-title28-section2403)&amp;f=treesort&amp;edition=prelim&amp;num=0&amp;jumpTo=true\" target=\"_blank\" rel=\"noopener\">28 U.S.C. \u00a72403<\/a>, certify to the appropriate attorney general that a statute has been questioned.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong> (c)\u00a0<em>Intervention;<\/em> <em>Final Decision on the Merits.<\/em><\/strong> Unless the court sets a later time, the attorney general may intervene within 60 days after the notice is filed or after the court certifies the challenge, whichever is earlier. Before the time to intervene expires, the court may reject the constitutional challenge, but may not enter a final judgment holding the statute unconstitutional.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong> (d)\u00a0<em>No Forfeiture<\/em>.<\/strong> A party\u2019s failure to file and serve the <a href=\"https:\/\/reunitethestates.org\/?page_id=10533\" target=\"_blank\" rel=\"noopener\">notice<\/a>, or the court\u2019s failure to certify, does not forfeit a constitutional claim or defense that is otherwise timely asserted.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"color: #993300;\"><strong><span style=\"font-size: 18pt;\">Various Types of Constitutional Challenges:<\/span><\/strong><\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/\/?page_id=9949\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">As-Applied Challenge<\/span><\/a> &#8211;
