To support the action it is necessary<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px; text-align: left;\" align=\"JUSTIFY\"><span style=\"font-size: 14pt; color: #800000;\"><strong> a.) That the property shall be personal.<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px; text-align: left;\" align=\"JUSTIFY\"><span style=\"font-size: 14pt; color: #800000;\"><strong> b.) More commonly, the claim for recovery of the chattel was pursued at common law under forms of action, such as <a href=\"https:\/\/reunitethestates.org\/\/?page_id=3927\">Detinue<\/a>\u00a0or Replevin. American statutes or court rules tracked the <a href=\"https:\/\/reunitethestates.org\/\/?page_id=3983\">common law<\/a> generally, referring to the recovery variously as replevin, detinue, claim-&amp;-delivery, or sequestration.
