Bryant&#8217;s\u00a0<a href=\"https:\/\/archive.org\/details\/cu31924020173419\" target=\"_blank\" rel=\"noopener\"><em>The Law of Pleading Under the Codes of Civl Procedure<\/em><\/a>\u00a0(2d ed. 1899):<\/strong><\/span><\/p>\n<p style=\"text-align: left;\" align=\"JUSTIFY\"><span style=\"font-size: 14pt;\"><strong>\u00a0 \u00a0 \u00a0\u201c<span style=\"color: #800000;\">The most important of the writs framed under the authority of the statute of Westminster 2 is that of &#8216;trespass on the case&#8217;, to meet cases analogous to trespass in delict, but lacking the element of direct or immediate force or violence. This writ gave a form of action in which the court was enabled to render judgment of damages in cases of fraud, deceit, negligence, want of skill, defamation oral or written, &amp; all other injurious acts or omissions resulting in harm to person or property, but wanting the <em>vi et armis<\/em> (\u201cwith force &amp; arms\u201d), the element of direct force &amp; violence, to constitute trespass.<\/span>\u201d\u00a0<\/strong>[2]<\/span><\/p>\n<p style=\"text-align: left;\" align=\"JUSTIFY\"><span style=\"font-size: 14pt;\"><strong>\u00a0 \u00a0 \u00a0Another excerpt from Edwin E.
