(18971):<\/span><\/strong><\/p>\n<p><strong><span style=\"color: #000000; font-size: 14pt;\">\u00a0 \u00a0 \u00a0&#8220;<span style=\"color: #800000;\">The term &#8217;eminent domain&#8217; is said to have originated with Grotius, the seventeenth century legal scholar. \u00a0Grotius believe that the state possessed the power to take or destroy property for the benefit of the social unity, but he believed that when the state so acted, it was obligated to compensate the injured property owner for his losses. \u00a0Blackstone, too, believed that society had no general power to take the private property of\u00a0<\/span><\/span><span style=\"color: #800000; font-size: 18.6667px; line-height: 31.1111px;\">landowners<\/span><span style=\"color: #800000;\"><span style=\"font-size: 14pt;\">, except on\u00a0the payment of a reasonable price. \u00a0The just compensation clause of the fifth amendment to the Constitution was built upon this concept of a moral obligation to pay for governmental interference with private property&#8230;.
