{"id":2838,"date":"2015-03-31T15:18:20","date_gmt":"2015-03-31T15:18:20","guid":{"rendered":"https:\/\/reunitethestates.org\/?page_id=2838"},"modified":"2017-12-12T01:41:25","modified_gmt":"2017-12-12T01:41:25","slug":"build-file-class-action-lawsuits","status":"publish","type":"page","link":"https:\/\/reunitethestates.org\/?page_id=2838","title":{"rendered":"Class-Action Lawsuits, Monopoly-Busting, and"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">class action<\/span>:<br \/>\n<\/strong><\/span><span style=\"font-size: 14pt;\">(1909)<\/span><\/p>\n<p style=\"text-align: left;\"><strong><span style=\"font-size: 14pt;\">1. <\/span><\/strong><span style=\"font-size: 14pt;\"><strong>A lawsuit in which the court authorizes a single person or a small group of people to represent the interests of a larger group; specifically a lawsuit in which the convenience cit lL\u2018l&#8217; of the public or of the interested parties requires that the case be settled through litigation lay or against only a part of the group of similarly Situated persons and in which person whose interests are or may he affected does not have an opportunity to protect his or\u00a0her<span class=\"text_exposed_show\">\u00a0interests by appearing personally or through a personally selected representative, or through a person specially appointed to act as a trustee or guardian.\u00a0 *\u00a0 Federal procedure has several prerequisites for maintaining a class action:<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left; padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span class=\"text_exposed_show\">(1) the class must be so large that individual suits would be impracticable,<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left; padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span class=\"text_exposed_show\">(2) there must be legal or factual questions common to the class,<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left; padding-left: 30px;\"><span style=\"font-size: 14pt;\"><strong><span class=\"text_exposed_show\">(3) the claims or defenses of the representative parties must be typical of those of the class, and<\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left; padding-left: 30px;\"><span style=\"font-size: 14pt;\"><span class=\"text_exposed_show\"><strong>(4) the representative parties must adequately protect the interests of the class. <a href=\"https:\/\/reunitethestates.org\/\/?page_id=4974\" target=\"_blank\" rel=\"noopener\">Fed. Langer<\/a>\u00a0<\/em>(1948):<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>\u00a0 \u00a0 \u00a0\u201c<span style=\"color: #800000;\">The class action was an invention of equity . . . mothered by the practical necessity of providing a procedural device so that mere numbers would not disable large groups of individuals, united in interest, from enforcing their equitable rights nor grant them immunity from their equitable wrongs. . . .
