The word &#8220;execution&#8221; does not necessarily mean the\u00a0<a class=\"mw-redirect\" title=\"Death penalty\" href=\"http:\/\/en.wikipedia.org\/wiki\/Death_penalty\">death penalty<\/a>; it refers to the imposition of whatever judgment is being stayed.<\/h4>\n<h4>\u00a0 \u00a0A stay can be granted automatically by operation of law or, when the parties in a civil or criminal case agree that no execution shall occur for a certain period.\u00a0If a party\u00a0<a title=\"Appeal\" href=\"http:\/\/en.wikipedia.org\/wiki\/Appeal\">appeals<\/a>\u00a0a decision, any judgment issued by the original court may be stayed until the appeal is resolved.<\/h4>\n<h3 style=\"text-align: center;\"><span style=\"color: #ff0000;\">NOTE<\/span>: \u00a0Rulings\u00a0may\u00a0be challenged as\u00a0<a title=\"Unfounded &amp;\/or not in accordance with law\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/5\/706\" target=\"_blank\" rel=\"noopener\">&#8220;Arbitrary &amp; Capricious&#8221;<\/a>\u00a0<em>(unfounded &amp;\/or &#8220;not in accordance with law)<\/em><\/h3>\n<h5><span style=\"color: #ff0000;\">NOTE:<\/span> \u00a0The phrase &#8220;<b>by operation of law<\/b>&#8221; is a\u00a0<a title=\"Legal term\" href=\"http:\/\/en.wikipedia.org\/wiki\/Legal_term\">legal term<\/a>\u00a0that indicates that a right or liability has been created for a party, irrespective of the intent of that party, because it is dictated by existing legal principles. For example, if a person dies without a\u00a0<a class=\"mw-redirect\" title=\"Will (law)\" href=\"http:\/\/en.wikipedia.org\/wiki\/Will_(law)\">will<\/a>, his\u00a0<a class=\"mw-redirect\" title=\"Heirs\" href=\"http:\/\/en.wikipedia.org\/wiki\/Heirs\">heirs<\/a>\u00a0are determined by operation of law. Stays<\/h5>\n<h5>1. A stay may be granted by a Justice as permitted by law.<\/h5>\n<h5>2. A party to a judgment sought to be reviewed may pre\u00adsent to a Justice an application to stay the enforcement of that judgment. See <a title=\"28 U.S.C. 2101(f)\" href=\"http:\/\/www.law.cornell.edu\/uscode\/text\/28\/2101\" target=\"_blank\" rel=\"noopener\">28 U. S. C. \u00a72101(f)<\/a>.<\/h5>\n<h5>3. An application for a stay shall set out with particularity why the relief sought is not available from any other court or judge. Except in the most extraordinary circumstances,<\/h5>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 32\">\n<div class=\"column\">\n<p>CLER$$RULE 04-29-13 14:06:10 PGT\u2022CTRULE<\/p>\n<\/div>\n<div class=\"layoutArea\">\n<div class=\"column\">\n<h5>28 SUPREME COURT RULE 24<\/h5>\n<h5>an application for a stay will not be entertained unless the relief requested was first sought in the appropriate court or courts below or from a judge or judges thereof. An application for a stay shall identify the judgment sought to be reviewed &amp;\u00a0have appended thereto a copy of the order and opinion, if any, &amp;\u00a0a copy of the order, if any, of the court or judge below denying the relief sought, &amp;\u00a0shall set out specific reasons why a stay is justified. The form &amp;\u00a0con\u00adtent of an application for a stay are governed by Rules 22 and 33.2.<\/h5>\n<h5>4. A judge, court, or Justice granting an application for a stay pending review by this Court may condition the stay on the filing of a supersedeas bond having an approved surety or sureties. The bond will be conditioned on the satisfaction of the judgment in full, together with any costs, interest, and damages for delay that may be awarded.
