A “cease &\u00a0desist<\/b>\u00a0letter”- also known as “infringement letter” or “demand letter”-<\/em> is an order or request that a party halt an activity<\/span> (“cease”) &\u00a0not take it up again later<\/span> (“desist”), else face legal action<\/span>.[1]<\/a><\/sup>[2]<\/a><\/sup>\u00a0The recipient of the letter may be an individual or an organization<\/span>.<\/h5>\n
\u00a0 \u00a0Receiving numerous cease &\u00a0desist letters may be very costly for the recipient.<\/span>\u00a0 Each claim in the letters has to be evaluated & responded to<\/span>; if there is no response & the Cease & Desist Order, & it\u00a0contains valid claims, the conditions are then ready for the enacting party to become the <\/span>litigate<\/a><\/span>\u00a0(the accuser & bringer of evidence on\u00a0behalf of a claim).<\/span><\/i><\/h5>\n
\u00a0 \u00a0Cease &\u00a0desist letters are sometimes used to\u00a0<\/span>intimidate<\/a>\u00a0their recipients<\/span>\u00a0& can be “an effective tool used by corporations to chill the critical speech of<\/span>\u00a0gripe site<\/a>\u00a0operators<\/span>.”\u00a0A company owning a\u00a0trademark<\/a>\u00a0may send such letter to a gripe site operator alleging a\u00a0trademark infringement<\/a>–\u00a0although the actual use of the trademark by the gripe site operator may fall under a\u00a0fair use<\/a>\u00a0exception (in compliance with, in the U.S., the protection of free speech under the\u00a0First Amendment<\/a>).<\/em><\/h5>\n
