Step 3 – How to Serve\u00a0The\u00a0Summons<\/a>\u00a0to the Defendant:<\/strong><\/p>\n

\u00a0 \u00a0 A Summons<\/a>\u00a0must be served with<\/em> a copy of the Complaint<\/a> to each\u00a0Defendant<\/a>\u00a0within 90 days after filing the\u00a0Complaint<\/a>\u00a0with the Clerk of Court\u00a0by a responsible party who is at least 18 years old & not<\/em> a party in the case. \u00a0At the\u00a0Plaintiff’s<\/a>\u00a0request, the court may order that service be made by a U.S. marshal or deputy marshal<\/a> or by a person specially appointed by the court. \u00a0The court must<\/em> so order if the\u00a0Plaintiff<\/a> is authorized to proceed with a Court Fee Waiver <\/a><\/strong>(see\u00a0in forma pauperis under 28 U.S.C. \u00a71915<\/a>\u00a0<\/strong>or as a seaman<\/a><\/strong> under<\/em> 28 U.S.C. \u00a71916 <\/a><\/em><\/strong>to learn about<\/em>\u00a0Court Fee Waivers<\/a><\/em><\/strong>)<\/em>.\u00a0<\/strong>(Rule 4(c) <\/strong><\/em>explains this section) \u00a0There are several methods in which an individual may serve a<\/strong>\u00a0Defendant(s)<\/a>. \u00a0<\/strong><\/em>These methods are explained in<\/strong> Rules 4(e) through (j), depending on who or which type of individual or organization is being served:<\/strong><\/p>\n
