The doctrine that the <a href=\"https:\/\/reunitethestates.org\/?page_id=6513\" target=\"_blank\" rel=\"noopener\">statute of limitations<\/a>\u00a0will not bar a claim\u00a0if the plaintiff, despite diligent\u00a0<span style=\"line-height: 31.1111px;\">efforts<\/span>, did not discover\u00a0the injury until after the limitations period had expired, in which case the statute is upended or tolled until the plaintiff discovers the injury. \u00a0* \u00a0Equitable tolling does not require misconduct such as concealment by the defendant.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><strong><span style=\"color: #000000;\">2. The doctrine that if a plaintiff files a suit first in one court and then refiles in another, the statute of limitations does not run when the litigation is pending in the first court if various requirements are not met. \u00a0* \u00a0Among those requirements are\u00a0<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><strong><span style=\"color: #000000;\">(1) timely notice to the defendant;<\/span><\/strong><\/span><br \/>\n<span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><strong><span style=\"color: #000000;\">(2) no prejudice to the defendant; and<\/span><\/strong><\/span><br \/>\n<span style=\"font-size: 12pt; font-family: arial, helvetica, sans-serif;\"><strong><span style=\"color: #000000;\">(3) reasonable and good-faith conduct on the party fo the plaintiff.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 12pt; color: #000000; font-family: arial, helvetica, sans-serif;\"><strong>3.
