\n<\/span><\/strong><\/span>(18c.)<\/span><\/p>\n

1. Control or dominion over a property without actual possession<\/a> or custody of it.\u00a0<\/strong>\u2014 aka effective possession<\/strong><\/span><\/em>.<\/span><\/p>\n

2. <\/strong>Civil law.<\/em> Possession by operation of law of an entirety by virtue of corporeal possession of a part.\u00a0 When a possessor holds title to a property and physically possesses part of it, the law will deem the possessor to hold constructive possession of the rest of the property described in the title.\u00a0<\/strong>\u2014 aka possessio fictitia<\/span><\/em>; possession in law. <\/span><\/em><\/strong>[1]<\/span><\/span><\/span><\/p>\n

1. That possession which the law annexes to the title; sometimes called legal possession, or possession in law, to distinguish it from possession in deed or in fact, which actual occupancy gives. 42 Am J1st Prop\u00a0\u00a7 42<\/span>.<\/span><\/strong><\/p>\n

As applied to a disseisor:\u00a0\u2014 a claim of ownership under color of title to a tract of land of which only a part is in the actual possession<\/a> of the claimant. 3 Am J2d Adv P\u00a0\u00a7 18<\/span>.<\/span><\/strong><\/p>\n

By force of statute, payment of taxes, under color of title, is\u00a0<\/span>constructive<\/span>\u00a0possession of unimproved and uninclosed land. \u00a0Such\u00a0possession is\u00a0<\/span>constructive<\/span><\/a>\u00a0adverse possession as\u00a0distinguished from actual adverse possession. <\/span><\/span>Canaday v Miller<\/em>, 102 Kan 577, 171 P 651<\/span>.<\/span><\/span><\/strong> [2]<\/span><\/p>\n

As opposed to actual possession<\/a>, possession that the law infers from the circumstances; possession in law as opposed to possession in fact. \u00a0EXAMPLE: a person claiming a tract of land under color of right or color of title, who is in actual possession<\/a> of a portion of it, is in constructive possession of the entire tract.<\/strong> [3]<\/span><\/p>\n
