\n<\/strong>(1987)<\/span><\/p>\n

1. A remedy intended to give the promisee something. as a replacement for the promised performance or to give the plaintiff something in lieu of preventing or repairing an injury<\/a>.\u00a0 *\u00a0 A court awards a substitutional remedy by ordering a defaulting <\/strong>seller of goods to pay the buyer damages (as opposed to delivering the promised goods).<\/strong> \u2014 aka substitutionary remedy<\/strong><\/em><\/span>.<\/span><\/p>\n

\u00a0\u00a0\u00a0\u00a0 Excerpt from Douglas Laycock,<\/span> The Death of the Irreparable Injury Rule<\/em><\/a> 13 (1991):<\/span><\/span><\/strong><\/p>\n

\u00a0\u00a0\u00a0\u00a0 \u201cWith substitutionary remedies, plaintiff suffers harm and receives a sum of money.\u00a0 Specific remedies seek to avoid this exchange.\u00a0 They seek to prevent harm, or undo it, rather than let it happen and compensate for it. . . . [Money damages] are substitutionary both in the sense that the sum of money is substituted for plaintiff\u2019s original entitlement, and in the less obvious sense that the fact finder<\/a>\u2019s valuation of the loss<\/a> is substituted for plaintiff\u2019s valuation.\u00a0 Specific relief seeks to avoid both these substitutions, giving plaintiff the very thing he lost if that is what he wants.<\/span>\u201d<\/strong> [2]<\/span><\/p>\n
