A claimant\u2019s act of choosing between two or more concurrent but inconsistent remedies based on a single set of facts.\u00a0 <\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>2. The affirmative defense barring a litigant from pursuing a <a href=\"https:\/\/reunitethestates.org\/?page_id=11648\" target=\"_blank\" rel=\"noopener\">remedy<\/a> inconsistent with another <a href=\"https:\/\/reunitethestates.org\/?page_id=11648\" target=\"_blank\" rel=\"noopener\">remedy<\/a> already pursued, when that other <a href=\"https:\/\/reunitethestates.org\/?page_id=11648\" target=\"_blank\" rel=\"noopener\">remedy<\/a> has given the litigant an advantage over, or has damaged, the opposing party.\u00a0 *\u00a0 This doctrine has largely fallen into disrepute and is now rarely applied.\u00a0 <\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>3. The affirmative defense that a claimant cannot simultaneously recover <a href=\"https:\/\/reunitethestates.org\/?page_id=6814\" target=\"_blank\" rel=\"noopener\">damages<\/a> based on two different <a href=\"https:\/\/reunitethestates.org\/?page_id=7031\" target=\"_blank\" rel=\"noopener\">liability <\/a><\/strong><strong>findings if the injury is the same for both claims, thus <\/strong><strong>creating a double recovery.<\/strong> [1]\u00a0 <\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1. The choosing between two or more different and co-existing modes of procedure and <a href=\"https:\/\/reunitethestates.org\/?page_id=11655\" target=\"_blank\" rel=\"noopener\">relief<\/a> allowed by law on the same state of facts. <span style=\"color: #800000;\"><em>Mansfield v Pickwick Stages<\/em>, 191 Cal 129, 215 P 389<\/span>. <\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>The doctrine, not a rule of <a style=\"color: #000000;\" href=\"https:\/\/reunitethestates.org\/?page_id=8731\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #008000;\">substantive law<\/span><\/a> but a technical rule of procedure, that the adoption, by an unequivocal act, of one of two or more inconsistent remedial rights has the effect of precluding a resort to the others. <span style=\"color: #800000;\"><em>Arzuaga v Gonzalez<\/em> (CA1 Puerto Rico) 239 F 60<\/span>.<\/strong> [2] <\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1.
