The affirmative defense barring a litigant from pursuing a remedy<\/a> inconsistent with another remedy<\/a> already pursued, when that other remedy<\/a> has given the litigant an advantage over, or has damaged, the opposing party.\u00a0 *\u00a0 This doctrine has largely fallen into disrepute and is now rarely applied.\u00a0 <\/strong><\/span><\/p>\n
