\u00a0\u00a0\u00a0\u00a0 \u201c[T]he best test of whether an act is culpably negligent in the particular case is to inquire whether there was a duty to exercise ordinary care, or something more or less than ordinary care, incumbent upon the party, and whether he had reasonably fulfilled that duty; if he has, he is not negligent; if he has not, he is negligent. The words \u2018ordinary\u2019 and \u2018reasonably\u2019 are no doubt vague, but the subject is only further obscured by the introduction of the words \u2018gross\u2019 and \u2018slight\u2019 because nobody can really say what they mean, though anybody may easily give to them some peculiar or exaggerated meaning.<\/span>\u201d<\/strong> [4]<\/span><\/p>\n
