1. A plaintiff\u2019s own negligence that played a part in causing the plaintiff\u2018s injury and that is significant enough (in a few jurisdictions) to bar the plaintiff from recovering damages.\u00a0 *\u00a0 While assumption of the risk denotes the voluntary incurring of the chance of an accident, contributory <\/strong>negligence denotes negligence that contributes to a particular accident that actually occurs. In some circumstances the two concepts can be difficult to distinguish. <\/strong><\/span><\/p>\n

2. A negligence-based legal defense that constitutes a bar to liability.\u00a0 *\u00a0 In most jurisdictions, this defense has been superseded by comparative negligence.<\/strong>
\n<\/span><\/p>\n
