The rule that if one of the elements of a crime is such that is can only be committed by two persons acting together (EXAMPLES: adultery; illicit cohabitation), such mutual action cannot also be a <a href=\"https:\/\/reunitethestates.org\/?page_id=6952\" target=\"_blank\" rel=\"noopener\">conspiracy<\/a>.\u00a0 This principle is also referred to as the Wharton Rule.\u00a0<\/strong> [2]<\/span><\/p>\n<div class=\"text_exposed_show\">\n<p><strong><span style=\"font-size: 14pt; color: #000000;\">\u00a0\u00a0\u00a0\u00a0 Excerpt from<span style=\"color: #800000;\"> <em>Iannelli v. U.S<\/em>., 420 US. 770, 785-86, 95 S.Ct. 1284, 1293-94 (1975)<\/span>:<\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0\u00a0\u00a0\u00a0 \u201c<span style=\"color: #800000;\">Wharton\u2019s Rule applies only to offenses that require concerted criminal activity, a plurality of criminal agents.
